Photo by Bruce Gordon \/ Ecoflight<\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">&#8216;They snuck through&#8217;: Tribes condemn shipment of uranium material through their lands<\/div>\r\n<div class=\"date\">Wednesday, July 31, 2024<\/div>\r\n<div class=\"byline\">By Acee Agoyo<\/div>\r\n<div class=\"source\">Indianz.Com<\/div>\r\n<p><\/p>\r\nTribal leaders are condemning the primary producer of uranium in the United States for transporting hazardous materials through their territories without their consent and without advance notice.\r\n<P><\/p>\r\nThe <a href=\"https:\/\/theofficialhavasupaitribe.com\/\">Havasupai Tribe<\/a> and the <a href=\"https:\/\/www.navajo-nsn.gov\/\">Navajo Nation<\/a> were informed on Tuesday morning that <a href=\"https:\/\/www.energyfuels.com\/\">Energy Fuels Resources Inc.<\/a> had begun transporting uranium ore through Arizona. But the notice came not from the company but from the <a href=\"https:\/\/www.fs.usda.gov\/\">U.S. Forest Service<\/a>, prompting tribal leaders to accuse the producer of going back on its word regarding shipments   from  the <a href=\"https:\/\/www.energyfuels.com\/pinyon-plain-mine\">Pinyon Plain Mine<\/a> near the Grand Canyon  to a processing site in neighboring Utah.\r\n<P><\/P>\r\n\u201cThey snuck through the Navajo Nation and they made it onto the Utah side, outside of the reservation,\u201d   <a href=\"https:\/\/opvp.navajo-nsn.gov\/president\/\">President Buu Nygren<\/a> said in a <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2024\/07\/31\/navajo073024.pdf\">news release<\/a>. \u201cTo me, they operated covertly to travel the Navajo Nation illegally. It&#8217;s very disappointing that they did that, that they smuggled uranium across our Nation which is very inappropriate.\u201d\r\n<P><\/P>\r\n<iframe loading=\"lazy\" src=\"https:\/\/www.facebook.com\/plugins\/post.php?href=https%3A%2F%2Fwww.facebook.com%2Fnavajonationcouncil%2Fposts%2Fpfbid0zxEU7eoqmrcZfEY7U1L8cStEtHVFf8Mj9dKM3g6Up9xVbNeuu49NP8saEC6RrAchl&#038;show_text=true&#038;width=500\" width=\"500\" height=\"478\" style=\"border:none;overflow:hidden\" scrolling=\"no\" frameborder=\"0\" allowfullscreen=\"true\" allow=\"autoplay; clipboard-write; encrypted-media; picture-in-picture; web-share\"><\/iframe>\r\n<P><\/P>\r\nHavasupai leaders also condemned the shipment of uranium ore, mined from a site near their <a href=\"https:\/\/en.wikipedia.org\/wiki\/Havasupai_Indian_Reservation\">reservation<\/a>. In a statement, they said Energy Fuels didn&#8217;t even give the federal government advance notice.\r\n<P><\/P>\r\n&#8220;EFRI blatantly disregarded its good faith promise and notified\r\nthe U.S. Forest Service hours after the haul trucks departed the mine site,&#8221; the <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2024\/07\/31\/havasupai073024.pdf\">Havasupai statement<\/a> read. &#8220;EFRI has confirmed by its actions today that it cannot be trusted.&#8221;\r\n<P><\/P>\r\nThe U.S. Forest Service confirmed that it wasn&#8217;t told in advance. According to the <a href=\"https:\/\/www.fs.usda.gov\/kaibab\">Kaibab National Forest<\/a>, federal officials were told on the &#8220;morning of July 30&#8221; about the transport of uranium ore from Arizona to Utah.\r\n<P><\/P>\r\n&#8220;The Forest Service had requested advance notification; however, there were no requirements for the mine to do so,&#8221; the <a href=https:\/\/www.fs.usda.gov\/detail\/kaibab\/home\/?cid=FSM91_050263>agency&#8217;s website about the Pinyon Plain Mine<\/a> states.\r\n<p><\/p>\r\n<div class=row><div class=col-10>\r\n<div class=\"h5-responsive sub\">Havasupai Tribe: &#8216;We, the Havasu Baaja, will not back down&#8217;<\/div>\r\n<div class=\"wp-block-pdfemb-pdf-embedder-viewer\"><a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2024\/07\/31\/havasupai073024.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-toolbar=\"both\" data-toolbar-fixed=\"on\">havasupai073024<\/a><\/div>\r\n<\/div><\/div>\r\n<p><\/p>\r\nLocal officials further confirmed they were informed &#8212; by the federal government &#8212;  only on Tuesday. The uranium ore was transported on highways entirely within Coconino County, including a busy interstate that goes through Flagstaff, the most populous city in the area.\r\n<p><\/p>\r\n&#8220;The Coconino County Manager\u2019s Office and Emergency Management staff are monitoring the situation,&#8221; an <a href=\"https:\/\/www.coconino.az.gov\/CivicAlerts.aspx?AID=3113\">online statement<\/a> read.\r\n<P><\/P>\r\nAlthough Pinyon Plain Mine, <a href=https:\/\/news.unm.edu\/news\/a-new-look-at-grand-canyon-springs-and-possible-threats-from-uranium-mining>formerly known as Canyon Uranium Mine<\/a>, has been   <a href=\"https:\/\/www.sierraclub.org\/arizona\/pinyon-plain-mine-formerly-canyon-mine\">permitted since the 1980s<\/a>, the current situation began earlier this year. Courtesy photo<\/figcaption>\r\n<P><\/P>\r\nEnergy Fuels notified the <a href=https:\/\/www.epa.gov\/>Environmental Protection Agency<\/a> late last year that it had begun operations at Pinyon Plain, located near <a href=https:\/\/www.fs.usda.gov\/detail\/kaibab\/home\/?cid=FSEPRD1129246>Red Butte, a sacred place<\/a>. Since then,   Havasupai leaders  said they have been &#8220;forced to witness the degradation of our aboriginal territory that encompasses the mine site.&#8221;\r\n<p><\/p>\r\n&#8220;Our tribe remains well versed with the wide array of health risks associated with radioactive contamination,&#8221; the Havasupai statement reads. &#8220;Our purpose of opposing uranium mining remains for the protection of our drinking water and the health and safety of our tribal members and tourists who visit our reservation.&#8221;\r\n<P><\/P>\r\nAfter learning about the shipment on Tuesday morning, Navajo President Nygren  <a href=https:\/\/www.facebook.com\/share\/p\/GsR98aUutFNY3DB2\/>dispatched tribal police<\/a> to try to stop the &#8220;illegal transportation&#8221; of uranium ore that went through highways on the reservation. A photo he shared on social media showed what he said was one of two trucks  on  Navajo lands &#8212; the truck had a &#8220;Radioactive&#8221; warning on it.\r\n<p><\/P>\r\nThe <a href=\"https:\/\/nndoj.navajo-nsn.gov\/Directory\/Office-of-Attorney-General\">tribe&#8217;s highest legal official<\/a> called the action a violation of its sovereignty.\r\n<P><\/P>\r\n\u201cEven though there is a state right of way for some of the path that the trucks will be taking across the Nation, that doesn&#8217;t mean that we don&#8217;t have any right to regulate that territory,\u201d <a href=\"https:\/\/www.facebook.com\/navajoagbranch\/\">Navajo Nation Attorney General Ethel Branch<\/a> said.  \u201cIt&#8217;s still Navajo trust land. However, the <a href=https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2023\/08\/08\/fact-sheet-president-biden-designates-baaj-nwaavjo-itah-kukveni-ancestral-footprints-of-the-grand-canyon-national-monument\/>designation made by President Joe Biden<\/a> in August 2023 does not stop mining there.\r\n<p><\/p>\r\n&#8220;Existing mining claims \u2013 predating a 20-year mineral withdraw initiated in 2012 \u2013 will remain in place, and the two approved mining operations within the boundaries of the monument would be able to operate,&#8221; the White House said as it called the designation of <EM>Baaj Nwaavjo I\u2019tah Kukveni<\/em> a victory for the <a href=https:\/\/www.grandcanyontrust.org\/grand-canyon-uranium>protection of sacred tribal sites<\/a>.\r\n<p><\/p>\r\nPinyon Plain  is also less than 10 miles from the gates of <a href=https:\/\/www.nps.gov\/grca>Grand Canyon National Park<\/a>, which draws millions of tourists not only to federally-managed lands   but to the Havasupai Reservation.
