The litigation against <a href=https:\/\/en.wikipedia.org\/wiki\/Alligator_Alcatraz>Alligator Alcatraz<\/a> &#8212; and the fact that the tribe had previously secured a legal victory in federal court &#8212; was the source of Trump&#8217;s retaliation against the Miccosukee people.\r\n<p><\/p>\r\n&#8220;The Tribe\u2019s constitutional commitment to this land runs deep: &#8216;It\u2019s written\r\ninto their Constitution to protect the Everglades because the Everglades protected\r\nthem when they were being hunted by the Government,'&#8221; the <a href=\"https:\/\/indianz.com\/News\/miccosukee011326\/\">58-page document<\/a> reads\r\n<P><\/P>\r\nAccording to the brief, the history of being hunted by the United States is continuing &#8212; nearly two centuries after a series of conflicts in the 1800s <a href=https:\/\/en.wikipedia.org\/wiki\/Second_Seminole_War>known as the Seminole Wars<\/a>.\r\nPhysical checkpoints are hindering access to traditional sites in the <a href=https:\/\/www.nps.gov\/bicy\/index.htm>Big Cypress National Preserve of Florida<\/a> and armed guards are patrolling areas where Miccosukee citizens have long practiced their culture.\r\n<p><\/p>\r\n&#8220;The physical barriers erected around the facility now block Tribal members\u2019\r\nprimary access to Big Cypress for traditional activities,&#8221; the brief states.\r\n&#8220;Checkpoints and guards stand where open land once welcomed Tribal hunters, fishers, and\r\ngatherers.&#8221;\r\n<P><\/P>\r\n&#8220;Tribal members now face the inadvisable prospect of &#8216;approach[ing] the security guards armed prepared for hunt,'&#8221; the brief reads.\r\n<p><\/p>\r\n<a href=\"https:\/\/indianz.com\/News\/2025\/08\/25\/native-america-calling-tribal-concerns-help-derail-fast-track-for-alligator-alcatraz\/aligatoralcatraz\/\" rel=\"attachment wp-att-206328\"><img loading=\"lazy\" decoding=\"async\" width=\"2048\" height=\"1365\" data-attachment-id=\"206328\" data-permalink=\"https:\/\/indianz.com\/News\/2025\/08\/25\/native-america-calling-tribal-concerns-help-derail-fast-track-for-alligator-alcatraz\/aligatoralcatraz\/\" data-orig-file=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2025\/08\/25\/aligatoralcatraz.jpg\" data-orig-size=\"2048,1365\" data-comments-opened=\"0\" data-image-title=\"Alligator Alcatraz\" data-image-description=\"&lt;p&gt;The Alligator Alcatraz facility in Ochopee, Florida, is operated by the state government as a detention facility for immigrants. The detention facility lies near the  border of the Miccosukee Reservation, and  several tribal communities &#8212; including two schools &#8212; are  located in close proximity to the controversial site.\r\n<p><\/p>\r\nBut in spite of the tribe&#8217;s longtime existence in the Everglades,  Miccosukee leaders say they were never consulted by the state of Florida, or by the federal government, about Alligator Alcatraz. As a result, they say their people are facing &#8220;ongoing harms&#8221; from the operation of the first state-run, federally-funded immigration detention facility in their own backyard.\r\n<p><\/p>\r\n&#8220;Adding insult to injury is that these harms were entirely avoidable. Had the\r\nDefendants engaged in meaningful consultation with the Tribe, as required under\r\n[federal law], the Tribe\u2019s objections could have surfaced earlier and the Tribe\r\ncould have proposed alternatives before harm occurred,&#8221; the brief states in reference to the Florida Division of Emergency Management, the U.S. Department of Homeland Security and the U.S. Immigration and Customs Enforcement.\r\n<P><\/P>\r\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">&quot;This is a treaty violation. Treaties are not optional. Sovereignty is not conditional. Our citizens are not negotiable&quot;: Oglala Sioux Tribe says at least four tribal citizens were detained by <a href=\"https:\/\/twitter.com\/hashtag\/ICE?src=hash&amp;ref_src=twsrc%5Etfw\">#ICE<\/a> in Minnesota. Government agents have brutalized Native people and have taken Native people  into custody  despite American Indians and Alaska Natives being citizens of the United States  for more than a century.\r\n<p><\/p>\r\nIn Minneapolis, Minnesota, for example, several tribal citizens reportedly have   been   detained by  Immigration and Customs Enforcement (ICE) agents. On Tuesday, the <a href=https:\/\/www.facebook.com\/permalink.php?story_fbid=pfbid0rTtFRmuAMxJwyJJwgAwLPyQWCZnMPtQjwBGPWuzzdSJ4ZRX9FLWb8ARneUMghVcSl&#038;id=100088883140525>Oglala Sioux Tribe said it has been given only the first names of four Oglala citizens who were taken into custody<\/a> as part of a violent &#8212; and deadly &#8212;  immigration crackdown in a state where Native people make up about <a href=https:\/\/data.census.gov\/profile\/Minnesota?g=040XX00US27>1.2 percent of the population<\/a>.\r\n<p><\/p>\r\nAccording to the tribe, one of its citizens was released after being detained by  ICE in Minnesota. But the others are reportedly being held at a <a href=https:\/\/www.ice.gov\/field-office\/st-paul-field-office>federal facility in Fort Snelling<\/a>,  the same place where <a href=https:\/\/en.wikipedia.org\/wiki\/Dakota_War_of_1862>Native people were once held as prisoners<\/a> prior to the hanging of 38 Dakota men in the <a href=https:\/\/deathpenaltyinfo.org\/stories\/the-largest-mass-execution-in-us-history>largest single-day mass execution in U.S. history<\/a> in December 1862. Two Dakota chiefs were later executed &#8212; <a href=https:\/\/www.mnhs.org\/fortsnelling\/learn\/us-dakota-war>at Fort Snelling<\/a>.\r\n<p><\/p>\r\n&#8220;The irony is not lost on us,&#8221;  <a href=https:\/\/www.facebook.com\/profile.php?id=100088883140525>President Frank Star Comes Out<\/a> said in a <a href=https:\/\/x.com\/indianz\/status\/2011224338373165126>news release on Tuesday<\/a>. &#8220;Lakota citizens who are reported to be held at Fort Snelling &#8212; a site forever tied to the Dakota 38+2 &#8212; underscores why treaty obligations and federal accountability matter today, not just in history.&#8221;\r\n<p><\/p>\r\n&#8220;This is not a misunderstanding or an enforcement discretion issue,&#8221;   Star Comes Out added. &#8220;This is a treaty violation.&#8221;\r\n<p><\/p>\r\n&#8220;Treaties are not optional,&#8221; Star Comes Out said. &#8220;Sovereignty is not conditional. According to the tribe, 8,000 Red Lake citizens live in the Minneapolis-St. Paul metropolitan area &#8212; with one <a href=https:\/\/ictnews.org\/news\/i-felt-like-i-was-kidnapped-ojibwe-man-recounts-ice-detainment\/>Red Lake descendant having reported being dragged from a car by federal agents<\/a> before being detained. <a href=https:\/\/ictnews.org\/news\/i-felt-like-i-was-kidnapped-ojibwe-man-recounts-ice-detainment\/>According to ICT<\/a>, 20-year-old Jose Roberto \u201cBeto\u201d Ramirez was sent to the ICE facility at Fort Snelling in the Twin Cities.\r\n<P><\/p> \r\n&#8220;We all need to be extra careful, and we must assume that ICE will not protect us, the <a href=https:\/\/www.facebook.com\/permalink.php?story_fbid=pfbid02SbyQVae2UCq6M2tEVn22vf2kDDLdGoiYm5iStvttLqubnYitGSN6xk92MQStvnNTl&#038;id=100069089034354>Red Lake Nation said in a statement<\/a> on January 7. &#8220;In fact, we can assume that anyone associated with the Trump administration, especially ICE, is hostile to us and that ICE will only detain us, or hurt us.&#8221;\r\n<P><\/P>\r\nThe ongoing crackdown resulted in the <a href=https:\/\/en.wikipedia.org\/wiki\/Killing_of_Renee_Good>killing of  Renee Nicole Good<\/a>, a non-Native woman, by an ICE agent on January 7.  <a href=https:\/\/mn.gov\/governor\/about\/peggyflanagan\/>Lt. Governor Peggy Flanagan<\/a> (D),  a citizen of the <a href=https:\/\/www.whiteearth.com\/>White Earth Nation<\/a>  who is the highest-ranking Native woman in  state executive office, is calling  on the Trump administration to withdraw its presence in Minnesota\r\n<P><\/P>\r\n&#8220;This is happening across the state of Minnesota &#8212; and it&#8217;s not OK,&#8221; <a href=https:\/\/www.facebook.com\/reel\/2944627082414618>said Flanagan<\/a>, who is <a href=https:\/\/peggyflanagan.com>campaigning to be the first Native woman<\/a> to serve in the  U.S. Senate<\/a>.\r\n<P><\/P>\r\nMinnesota, which is home to 11 tribal nations, happens to led by <a href=https:\/\/mn.gov\/governor\/about-gov\/timwalz\/>Governor Tim Walz<\/a> (D), who ran against Trump during the 2024 presidential election. Walz was the running mate of former U.S. vice president Kamala Harris, who was the Democratic nominee for president.\r\n<P><\/P>\r\nIn comparison, <a href=https:\/\/www.flgov.com\/eog\/>Florida Governor Ron  DeSantis<\/a> (R)  has been  far more friendly to Trump. Although Alligator Alcatraz is operated by the state, the federal government has provided significant funding for it &#8212; one of the many issues at contention in the lawsuit that the Miccosukee Tribe has joined.\r\n<p><\/p>\r\n&#8220;To be sure, a state contractor that operates a federal prison retains day-to-day operational authority, but no one would suggest the prison is therefore not a federal facility,&#8221; the tribe points out in its brief. &#8220;What matters is whether the federal government exercises &#8216;substantial control and responsibility&#8217;  &#8212; not whether it micromanages every operational detail.&#8221;\r\n<P><\/P>\r\nAlong with environmental and conservation groups, the tribe secured a legal victory when a federal judge  put a halt to the <a href=\"https:\/\/biologicaldiversity.org\/w\/news\/press-releases\/judge-halts-operations-at-everglades-detention-center-with-preliminary-injunction-2025-08-21\/\">federal government&#8217;s involvement at Alligator Alcatraz<\/a>. The 11th Circuit Court of Appeals, however, <a href=\"https:\/\/biologicaldiversity.org\/w\/news\/press-releases\/appeals-court-allows-destructive-everglades-facility-to-stay-open-2025-10-22\/\">allowed work to continue<\/a> without fully hearing the dispute on the merits.  \r\n<P><\/P>\r\nAnd while Alligator Alcatraz became operational last October, President Trump accused the tribe of hindering his immigration agenda. Without overtly citing  the lawsuit, he said the Miccosukees &#8220;actively sought  to obstruct reasonable immigration policies&#8221; when he vetoed a Republican-led bill that seeks to add a 30-acre tribal village known as the Osceola Camp to the Miccosukee Reservation in the Everglades of Florida.\r\n<P><\/P>\r\nIn addition to being sponsored by Republicans, \r\n<a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/504\">H.R.504<\/a>, the Miccosukee Reserved Area Amendments Act, has enjoyed broad bipartisan support.\r\nThe bill passed the <a href=\"https:\/\/www.house.gov\/\">U.S. House of Representatives<\/a> by a voice vote under a suspension of the rules, a process typically reserved for non-controversial legislation.\r\n<p><\/p>\r\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">FAILED! The Republican-led U.S. House of Representatives was unable to override the veto of H.R.504, the Miccosukee Reserved Area Amendments Act.<br><br>The roll call was 236 to 188, with the &quot;Yea&quot; votes falling short of the two-thirds need to override the veto. <a href=\"https:\/\/twitter.com\/hashtag\/HR504?src=hash&amp;ref_src=twsrc%5Etfw\">#HR504<\/a> <a href=\"https:\/\/twitter.com\/hashtag\/TribalHomelands?src=hash&amp;ref_src=twsrc%5Etfw\">#TribalHomelands<\/a> <a href=\"https:\/\/t.co\/LMbt4K68tP\">pic.twitter.com\/LMbt4K68tP<\/a><\/p>&mdash; indianz.com (@indianz) <a href=\"https:\/\/twitter.com\/indianz\/status\/2009360004193583401?ref_src=twsrc%5Etfw\">January 8, 2026<\/a><\/blockquote> <script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\r\n<P><\/P>\r\nRepublicans, however, quickly abandoned the tribe and refused to stand up to Trump. Last Thursday, they  failed to speak in support of overriding the veto on H.R.504 &#8212;  not even Rep. Carlos Gimenez (R-Florida), the Republican sponsor of the bill, came to the floor of the House to explain, defend  or promote the legislation.\r\n<P><\/p>\r\n&#8220;No one voted against this bill,&#8221; observed <a href=https:\/\/wassermanschultz.house.gov\/>Rep. Debbie Wasserman Schultz<\/a> (D-Florida), who was seen rushing to the floor in hopes of reviving H.R.504.\r\n<P><\/P>\r\n&#8220;This bill is entirely non-controversial and it is so narrowly focused that it makes absolutely no sense &#8212; other than the interest in vengeance that seems to have emanated in this result,&#8221; <a href=https:\/\/youtube.com\/shorts\/LXIYpdmiYG4?feature=share>added Wasserman Schultz<\/a>, accusing Trump of retribution for vetoing H.R.504.\r\n<P><\/P>\r\nThe only Republican who spoke about H.R.504 was <a href=https:\/\/westerman.house.gov\/>Rep. Bruce Westerman<\/a> (R-Arkansas), who chairs   the <a href=https:\/\/naturalresources.house.gov>House Committee on Natural Resources<\/a>, which is the legislative panel with <a href=https:\/\/naturalresources.house.gov\/issues\/issue\/?IssueID=5066>jurisdiction over Indian issues<\/a> in the chamber. However, he did not encourage Republicans to override Trump&#8217;s veto or   rebut the White House&#8217;s reasoning for rejecting the bill.\r\n<P><\/P>\r\n&#8220;I respect the president&#8217;s views on this legislation and his commitment to fiscal responsibility,&#8221;   <a href=https:\/\/www.youtube.com\/shorts\/T_Hrpy25spAe>Westerman said<\/a> on January 8.\r\n<P><\/P>\r\n<div class=row><div class=col-6>\r\n \r\n<iframe loading=\"lazy\"  width=\"397\" height=\"705\" src=\"https:\/\/www.youtube.com\/embed\/LXIYpdmiYG4\" title=\"&#39;No one voted against this bill&#39;\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\r\n \r\n<\/div>\r\n<div class=\"col-6\">\r\n<iframe loading=\"lazy\" width=\"397\" height=\"705\" src=\"https:\/\/www.youtube.com\/embed\/T_Hrpy25spA\" title=\"&#39;\u200aI respect the President&#39;s views on this legislation&#39;\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\r\n<\/div>\r\n<\/div>\r\n<p><\/p>\r\nIn contrast, <a href=https:\/\/huffman.house.gov\/>Rep. Jared Huffman<\/a> (D-California), the <a href=https:\/\/democrats-naturalresources.house.gov>highest-ranking Democrat on Natural Resources<\/a>, spoke in support of H.R.504. He too accused Trump of playing politics with  Indian Country legislation, which historically has been non-partisan in nature.\r\n<p><\/p>\r\n&#8220;Let me be clear, tribes are not special interests,&#8221; said Huffman, refuting one of Trump&#8217;s claims about the bill. &#8220;They&#8217;re not seeking special treatment. They&#8217;re sovereign nations with legal and moral responsibilities to protect the well-being of their citizens and their homelands  and the United States has a government-to-government responsibility to work with them.&#8221;\r\n<p><\/p>\r\n&#8220;Unrelated policy disagreements should never be used to undermine that relationship,&#8221; Huffman said in reference to the the trust and treaty obligations of the federal government.\r\n<p><\/p>\r\nTo <a href=https:\/\/www.congress.gov\/crs-product\/RS22654>override a veto<\/a>, at least two-thirds of the members of the House must vote in the affirmative.
