Image: <a href=https:\/\/www.archaeologysouthwest.org\/2024\/01\/22\/tribes-and-archaeology-southwest-sue-usblm-over-sunzia-transmission-line-route\/>Archaeology Southwest<\/a><\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">Tribes taken Biden administration to court over $4 billion energy project<\/div>\r\n<div class=\"date\">Wednesday, January 24, 2024<\/div>\r\n<div class=\"byline\">By Acee Agoyo<\/div>\r\n<div class=\"source\">Indianz.Com<\/div>\r\n<p><\/p>\r\nThe <a href=\"https:\/\/indianz.com\/News\/2024\/01\/24\/native-america-calling-in-the-rush-to-build-green-energy-tribes-sometimes-lose\/\">Biden administration&#8217;s renewable energy agenda<\/a> is being tested in court with a lawsuit from tribes opposed to a   $4 billion  development that runs through their homelands.\r\n<p><\/p>\r\nIn a complaint filed in federal court last week, the <a href=\"https:\/\/www.scat-nsn.gov\/\">San Carlos Apache Tribe<\/a> and the <a href=\"http:\/\/www.tonation-nsn.gov\/\">Tohono O&#8217;odham Nation<\/a> accused the <a href=https:\/\/www.doi.gov\/>Department of the Interior<\/a> of failing to consult them about the <a href=\"https:\/\/patternenergy.com\/projects\/sunzia\/\">SunZia Southwest Transmission Project<\/a>, which bills itself as the largest clean energy infrastructure development in U.S. history. The tribes say concerns about sacred sites in the <a href=\"https:\/\/en.wikipedia.org\/wiki\/San_Pedro_Valley\">San Pedro Valley<\/a> of southern Arizona have been ignored.\r\n<p><\/p>\r\n \u201cFor more than a decade, the San Carlos Apache Tribe and others have been raising alarms about the need to protect the cultural resources in the San Pedro Valley from the impacts of the SunZia project,&#8221; Chairman Terry Rambler  said in a <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2024\/01\/25\/tonscat012324.pdf\">news release <\/a>on Wednesday. &#8220;We join with the many other tribes whose sacred sites are endangered by this project in calling for a halt until our concerns are heard and addressed. We will keep fighting for a meaningful historic  preservation process that actually addresses the concerns that so many have raised.&#8221;\r\n<P><\/P>\r\nAccording to Tohono O\u2019odham Nation Chairman Verlon Jose,  his tribe informed the <a href=https:\/\/www.blm.gov\/>Bureau of Land Management<\/a> (BLM), an agency at Interior, and project developer <a href=\"https:\/\/en.wikipedia.org\/wiki\/Pattern_Energy\">Pattern Energy<\/a> about cultural resources in the San Pedro Valley. He alleges the Biden administration is violating the <a href=\"https:\/\/www.nps.gov\/subjects\/historicpreservation\/national-historic-preservation-act.htm\">National Historic Preservation Act<\/a>  (NHPA) by failing to protect sacred sites.\r\n<p><\/p>\r\n\u201cThe O\u2019odham and our ancestors the Hohokam have deep cultural and historical connections to the San Pedro Valley, with many sites of great significance,&#8221; Jose said in the release. &#8220;We have made BLM and the Pattern Energy aware of this, but their disregard for the NHPA process has put these cultural sites in danger of irreparable harm. Last September, she participated in a <a href=https:\/\/www.doi.gov\/pressreleases\/biden-harris-administration-celebrates-groundbreaking-new-sunzia-transmission-line>groundbreaking at the portion of the SunZia project<\/a> located in New Mexico, her home state.\r\n<p><\/p>\r\nAnd in November, only a month before the <a href=https:\/\/indianz.com\/News\/tag\/whtns\/>White House Tribal Nations Summit<\/a> convened by President Joe Biden, she highlighted the development as one of 15 renewable energy projects being advanced in Western states.\r\n<p><\/p>\r\n\u201cThe Biden-Harris administration is committed to expanding clean energy development to address climate change, enhance America\u2019s energy security and create good-paying union jobs. The projects we are advancing today will add enough clean energy to the grid to power millions of homes,\u201d <a href=https:\/\/www.blm.gov\/press-release\/biden-harris-administration-advances-15-onshore-clean-energy-projects-potential-power>Haaland told<\/a> a <a href=https:\/\/westgov.org\/meetings\/details\/2023-winter-meeting>meeting of the Western Governors Association  in Wyoming<\/a> on November 6.  \r\n<p><\/p>\r\nThe leader of the BLM also weighed in. <a href=\"https:\/\/www.blm.gov\/bio\/tracy-stone-manning\">Director Tracy Stone-Manning<\/a> said her agency is committed to permitting  25 gigawatts of solar, wind and geothermal production on public lands no later than 2025.\r\n<p><\/p>\r\n \u201cInvesting in clean and reliable renewable energy represents the BLM&#8217;s commitment to addressing climate change and supports direction from the President and Congress,&#8221; Stone-Manning said of the push from multiple sectors of the U.S. government.\r\n<P><\/p>\r\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Our clean energy future isn\u2019t some far off fantasy \u2013 it&#39;s real, it\u2019s here, and <a href=\"https:\/\/twitter.com\/Interior?ref_src=twsrc%5Etfw\">@Interior<\/a> is leading the charge in harnessing it for every American. <br><br>This week, we announced <a href=\"https:\/\/twitter.com\/BLMNational?ref_src=twsrc%5Etfw\">@BLMNational<\/a>&#39;s progress on 15 renewable energy projects across the West. <a href=\"https:\/\/t.co\/v79JPpkc73\">https:\/\/t.co\/v79JPpkc73<\/a><\/p>&mdash; Secretary Deb Haaland (@SecDebHaaland) <a href=\"https:\/\/twitter.com\/SecDebHaaland\/status\/1722268911104840126?ref_src=twsrc%5Etfw\">November 8, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\r\n<P><\/P>\r\nAccording to Interior,  the BLM has approved 46 clean energy projects   since Biden took office in 2021. These developments are expected to generate up to 11,236 megawatts of electricity &#8212; meaning the overall goal of permitting 25 gigawatts would require even more approvals.\r\n<P><\/P>\r\n&#8220;I think, personally,   that tribes are in favor of clean energy and wanting to do these projects that are light hand on the land and better for our environment,&#8221; Reno Keoni Franklin, the chairman of the  <a href=\"https:\/\/www.stewartspoint.org\/wp2\/\">Kashia Band of Pomo Indians<\/a>, based in California, said on the <a href=https:\/\/www.nativeamericacalling.com\/wednesday-january-24-2024-in-the-rush-to-build-green-energy-tribes-sometimes-lose\/>Native America Calling radio show on Wednesday<\/a>. \r\n<P><\/P>\r\n&#8220;But my stern warning to federal agencies has always been the same: Not on the backs of Indian tribes,&#8221; added Franklin, who also  <a href=https:\/\/www.achp.gov\/about\/council-members\/reno-keoni-franklin>serves on  the Advisory Council on Historic Preservation<\/a>, an independent federal agency that was created by the NHPA.  \r\n<p><\/P>\r\nPattern Energy expects to <a href=\"https:\/\/www.blm.gov\/press-release\/blm-issues-final-environmental-impact-statement-resource-management-plan-amendment\">generate up to 4,500 megawatts of electricity<\/a> through <a href=https:\/\/patternenergy.com\/projects\/sunzia-wind\/>SunZia Wind<\/a>, which the developer describes  as the largest wind project in the Western Hemisphere. According to the Tohono O&#8217;odham Nation and the  San Carlos Apache Tribe,  construction began last September &#8212; only for the BLM to order an &#8220;immediate temporary suspension&#8221; in early November after the tribes objected, their complaint  reads.\r\n<P><\/p>\r\nBut by the end of November, after the <a href=https:\/\/www.hopi-nsn.gov\/>Hopi Tribe<\/a> and the <a href=https:\/\/www.ashiwi.org\/>Pueblo of Zuni<\/a> also objected to SunZia&#8217;s transmission line, the BLM allowed Pattern Energy to resume construction without addressing the impacts to historic properties and cultural resources in the San Pedro Valley, the complaint alleges. That&#8217;s why the Tohono O&#8217;odham Nation and the  San Carlos Apache Tribe say they have been forced to go to court.\r\n<P><\/P>\r\n&#8220;Tribes are some of the leading supporters of alternative energy solutions,\u201d O&#8217;odham Chairman Jose said on Wednesday. \u201cHowever, there has been a pattern of bad faith going back many years. What else can you call the recent\r\ndecision to halt construction to hold consultations, and then start up construction again? Consultations to protect\r\nsacred areas while construction is already ongoing, and the route for the transmission line is already selected and\r\nnon-negotiable, shows clear bad faith on the part of the federal government.\u201d\r\n<p><\/p>\r\n&#8220;At this point, it is clear that the only way to compel BLM and Pattern Energy to follow the\r\nlaw is through the courts,&#8221; San Carlos Apache Chairman Rambler added. &#8220;We must take this action so that all the impacted tribes can have our concerns heard, instead of falling on deaf ears.&#8221;\r\n<P><\/P>\r\n<div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><p><\/p>\r\nThe Biden administration has not yet responded to the lawsuit, which has been assigned to <a href=https:\/\/en.wikipedia.org\/wiki\/Jennifer_Zipps>Judge Jennifer Zipps<\/a>, who was nominated to the federal bench by former president Barack Obama, a Democrat. But Pattern Energy is moving quickly &#8212;  on Tuesday, the company  <a href=https:\/\/indianz.com\/News\/wp-content\/uploads\/2024\/01\/25\/sunzia012324.pdf>filed a motion to intervene<\/a> as a defendant in the case, pointing to the economic impacts of the massive project.\r\n<p><\/p>\r\n&#8220;This suit puts at risk a renewable power supply for up to three million people, fulfillment of state and federal renewable energy targets, approximately 2,000 construction jobs, and over three billion dollars of existing investments out of a planned $11 billion worth of transmission and wind energy projects,&#8221; the <a href=https:\/\/indianz.com\/News\/wp-content\/uploads\/2024\/01\/25\/sunzia012324.pdf>court filing stated<\/a>.\r\n<p><\/p>\r\nPattern Energy&#8217;s defense team boasts a heavy hitter in <a href=https:\/\/indianz.com\/News\/2009\/03\/05\/native_woman_up_for_top_legal.asp>Hilary Tompkins<\/a>, a citizen of the <a href=https:\/\/www.navajo-nsn.gov\/>Navajo Nation<\/a> who made history during the Obama administration as the first Native person to serve as <a href=https:\/\/www.doi.gov\/solicitor>Solicitor at the Department of the Interior<\/a>, where she was in charge of the agency&#8217;s legal affairs. In a declaration submitted in court on Tuesday, he said work in the San Pedro Valley  &#8220;must be completed&#8221; between now and May in order for the project to remain on schedule to deliver power to markets in Arizona and California by 2026.\r\n<p><\/p>\r\n&#8220;This would delay commercial completion of the SunZia Transmission Line by up to one year, which would likely put its commercial viability at risk,&#8221; Wentzel stated in the <a href=https:\/\/indianz.com\/News\/wp-content\/uploads\/2024\/01\/25\/025127254176.pdf>sworn declaration<\/a>.\r\n<P><\/p>\r\nPattern Energy&#8217;s efforts have been <a href=https:\/\/patternenergy.com\/president-biden-remarks-on-pattern-energys-sunzia-wind-and-transmission-project\/>touted by President Biden<\/a> himself.
