Photo: <a href=https:\/\/www.facebook.com\/NezLizer2018\/>Navajo Nation Office of President and Vice President<\/a>\r\n<\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">Supreme Court\u2019s Census ruling a \u2018bitter pill\u2019 to tribes, advocates<\/div>\r\n<div class=\"date\">Wednesday, October 14, 2020<\/div>\r\n<div class=\"byline\">By Olivia Munson and Mythili Gubbi<\/div>\r\n<DIV class=source>Cronkite News<\/DIV>\r\n<DIV class=source-website><A \r\nhref=\"https:\/\/cronkitenews.azpbs.org\/\">cronkitenews.azpbs.org<\/A><\/DIV>\r\n<P><\/P>\r\nWASHINGTON &#8211; The Supreme Court Tuesday said the Census Bureau can stop its count of the population, a blow to tribal leaders and local advocates for underrepresented communities in Arizona who said they would be hit hardest by an undercount.<p><\/p>\r\n\r\nThe court blocked lower courts that had ordered the bureau to continue counting until October 31 and essentially allows the agency to stop counting \r\n<a href=\"https:\/\/2020census.gov\/en\/response-rates\/nrfu.html\">with 99.9%<\/a>\r\nof homes in the U.S. &#8211; and in Arizona &#8211; accounted for.\r\n<p><\/p>\r\n\r\nThe decision was immediately criticized by plaintiffs in the suit, who said ending enumeration before everyone is counted will just mean the groups they represent will continue to be left at &#8220;the margins of the U.S. society at large.&#8221;\r\n<p><\/p>\r\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">U.S. Supreme Court Issues Decision to End Census Operations <a href=\"https:\/\/t.co\/qOQVYvGvGI\">pic.twitter.com\/qOQVYvGvGI<\/a><\/p>&mdash; Gila River Indian Community (@GRIC_Official) <a href=\"https:\/\/twitter.com\/GRIC_Official\/status\/1316156869552078853?ref_src=twsrc%5Etfw\">October 13, 2020<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\r\n<P><\/P>\r\n&#8220;Today&#8217;s decision by the U.S. Supreme Court is a bitter pill for us to swallow here on the Reservation,&#8221; said Gila River Indian Community Gov. Stephen Roe Lewis said in a statement Tuesday evening. &#8220;With no explanation or rationale, a majority simply decided that our people do not deserve to be counted.&#8221;<p><\/p>\r\nHis tribe, along with the Navajo Nation, civil rights groups and local governments around the country, had filed suit to block a Census plan that would have ended the count on September 30.<p><\/p>\r\nThe bureau had first pushed the enumeration deadline back to October 31 to allow for time lost to <a href=\/covid19\/>COVID-19<\/a> restrictions. But it suddenly reversed course in August and said it needed to end enumeration by September 30 in order to have enough time to deliver a report to the president by December 31, as the law requires.<p><\/p>\r\n\r\nLower courts disagreed, noting that bureau officials had asked Congress for an extension this summer, arguing then that there was no way it could meet the Dec. 31 deadline. A district court judge \r\n<a href=\"https:\/\/www.brennancenter.org\/sites\/default\/files\/2020-10\/Order_10.1.2020.pdf\">ordered the Census<\/a>\r\nto keep counting until October 31, agreeing that the plaintiffs would be irreparably harmed by an undercount, which affects federal funding and congressional representation, among other things.\r\n<p><\/p><div class=row><div class=col-md-10>\r\n<div class=\"wp-block-pdfemb-pdf-embedder-viewer\"><a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2020\/10\/20a62_n7ip.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-toolbar=\"both\" data-toolbar-fixed=\"on\">20a62_n7ip<\/a><\/div><\/div><\/div>\r\n<p><\/p>\r\nThat ruling was upheld for the most part by a circuit court panel. But the Supreme Court stayed those orders over the objections of Justice Sonia Sotomayor, who said endangering the &#8220;accuracy of the census is not a cost worth paying.&#8221;<p><\/p>\r\n&#8220;The harms caused by rushing this year\u2019s census count are irreparable,&#8221; Sotomayor wrote \r\n<a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2020\/10\/20a62_n7ip.pdf\">in a dissent.<\/a>\r\n&#8220;And respondents will suffer their lasting impact for at least the next 10 years.&#8221;\r\n<p><\/p>\r\nThose in and supporting minority communities that filed the suit said they were disappointed with the ruling.<p><\/p>\r\nLisa Dancsok of the Arizona Community Foundation said that her organization had worked to increase the Census count of underrepresented areas in Arizona. The court&#8217;s ruling Tuesday will limit her organization&#8217;s &#8220;ability to get more people counted, which is going to be a misrepresentation of the true demographic makeup that we have in the state.&#8221;<p><\/p><div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><P><\/P>\r\nJoseph Garcia, executive director for Chicanos Por La Causa Action Fund, said the decision guarantees an undercount for the Latino community, and others, including tribal and rural communities.
