They are now permanently blocked from going into effect.<\/div>\r\n<div class=\"date\">Monday, October 3, 2022<\/div>\r\n<div class=\"byline\">By Alex Sakariassen<\/div>\r\n<DIV class=\"source\">Montana Free Press<\/DIV>\r\n<DIV class=\"source-website\"><A \r\nhref=\"https:\/\/montanafreepress.org\/\">montanafreepress.org<\/A><\/DIV>\r\n<P><\/P>\r\nA district court judge in Billings Friday <a href=https:\/\/indianz.com\/News\/wp-content\/uploads\/2022\/10\/03\/2022-09-30_Yellowstone_District_Court_Order.pdf>permanently struck down three election administration laws<\/a> in Montana, declaring that eliminating Election Day voter registration, implementing new voter identification requirements and barring paid ballot collection are unconstitutional.<P><\/P>\r\nThe order, issued by Yellowstone District Court Judge Michael Moses, closes the book on the court\u2019s deliberations in <a href=\"https:\/\/apps.montanafreepress.org\/montana-legislature-lawsuit-tracker\/#case-13-DV-21-0451\">a consolidated lawsuit<\/a> that started shortly after Republicans in the Montana Legislature passed the laws in spring 2021. The lawsuit was filed against Secretary of State Christi Jacobsen by the Montana Democratic Party, Western Native Voice, Montana Youth Action and a coalition of tribal and youth advocacy groups. Moses <a href=\"https:\/\/montanafreepress.org\/2022\/08\/26\/montana-election-trial-wraps\/\">presided over a nine-day trial last month<\/a>, during which he acknowledged the time-sensitive nature of the case given Montana\u2019s upcoming election and assured both sides he would reach a decision as quickly as possible.<P><\/P>\r\nIn his ruling, Moses noted that the law ending Election Day voter registration \u2014 <a href=\"https:\/\/apps.montanafreepress.org\/capitol-tracker-2021\/bills\/hb-176\">House Bill 176<\/a> \u2014 \u201cseverely burdens the right to vote of Montana voters, particularly Native American voters, students, the elderly, and voters with disabilities.\u201d He reached a similar conclusion regarding <a href=\"https:\/\/apps.montanafreepress.org\/capitol-tracker-2021\/bills\/hb-530\">House Bill 530<\/a>\u2019s prohibition on paid ballot collection. As for <a href=\"https:\/\/apps.montanafreepress.org\/capitol-tracker-2021\/bills\/sb-169\">Senate Bill 169<\/a>, which required student IDs to be accompanied by a second form of identification at the polls, Moses wrote that the law \u201cviolates the Equal Protection Clause by imposing heightened and unequal burdens on Montana\u2019s youngest voters.\u201d<P><\/P><div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><p><\/p>\r\nAll three laws had already been subject to <a href=\"https:\/\/montanafreepress.org\/2022\/04\/06\/judge-block-montana-voting-laws\/\">a preliminary injunction issued by Moses<\/a> this spring and <a href=\"https:\/\/montanafreepress.org\/2022\/09\/21\/montana-election-day-registration-back-on-per-supreme-court-ruling\/\">upheld by the Montana Supreme Court<\/a> this month. Moses\u2019 order vacates that temporary injunction, replacing it with a permanent ban on enforcement of the laws ahead of the November 8 general election. A <a href=\"https:\/\/apps.montanafreepress.org\/capitol-tracker-2021\/bills\/hb-506\">fourth law challenged in the lawsuit<\/a>, which barred counties from sending mail ballots to minors who would turn 18 by Election Day, was already declared unconstitutional by Moses this summer.<P><\/P>\r\nMoses\u2019 ruling was announced just before 5 p.m. on Friday.
