Photo: <a href=https:\/\/flickr.com\/photos\/usdagov\/9361218076\/>U.S. Department  of Agriculture<\/a><\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">25 states sue to force USDA to fund SNAP food aid during shutdown<\/div>\r\n<div class=\"date\">Wednesday, October 29, 2025<\/div>\r\n<div class=\"byline\">By Nick Karmia<\/div>\r\n<DIV class=source>Cronkite News<\/DIV>\r\n<DIV class=source-website><A \r\nhref=\"https:\/\/cronkitenews.azpbs.org\/\">cronkitenews.azpbs.org<\/A><\/DIV>\r\n<P><\/p>\r\n<p>WASHINGTON &#8212; Arizona and 24 other states sued the U.S. Department of Agriculture on Tuesday, accusing the Trump administration of illegally freezing food aid for 42 million Americans during the government shutdown.<\/p>\r\n<p>\u201cThis suspension of benefits doesn\u2019t just take food off of family\u2019s tables,\u201d state Attorney General Kris Mayes said at a news conference in Phoenix. \u201cIt sucks a huge amount of money out of Arizona\u2019s economy and it hurts everyone along the food supply chain.\u201d\u00a0<\/p>\r\n<p>The USDA <a href=\"https:\/\/www.documentcloud.org\/documents\/26196837-usda-memo-102425\/\">told states Friday<\/a> that the funds would run out eight days later, on November 1, despite a <a href=\"https:\/\/web.archive.org\/web\/20251001024645\/https:\/\/www.usda.gov\/sites\/default\/files\/documents\/fy2026-usda-lapse-plan.pdf\">plan<\/a> issued before the shutdown started Sept. 30 stating it would keep the Supplemental Nutrition Assistance Program running.\u00a0<\/p>\r\n<p>The <a href=\"https:\/\/www.azag.gov\/sites\/default\/files\/2025-10\/001%202025.10.28%20Complaint%20-%20MA%20v.%20USDA.pdf\">51-page complaint<\/a> filed in federal court in Massachusetts argues that the USDA is unlawfully cutting off funds for SNAP, which is often referred to as food stamps.<\/p>\r\n<p>The states say the department can and should tap its $6 billion contingency reserve to keep benefits flowing.\u00a0<\/p>\r\n<p>One in eight Americans rely on the program. Arizona follows the national average. In fiscal year 2024, the state issued just over $2 billion in SNAP benefits for 950,978 residents, including 401,455 children and 135,677 seniors, according to the lawsuit.<\/p>\r\n<p>\u201cSNAP benefits have never been interrupted by a lapse in appropriations,\u201d the lawsuit says.\u00a0<\/p>\r\n<p>The Trump administration defended its decision to let SNAP come to a halt for the first time during a shutdown, blaming Democrats for the impending crisis for blocking the Republican budget. <\/p>\r\n<p>Acknowledging that 42 million Americans &#8220;face hunger November 1 without SNAP funding,&#8221; Secretary of Agriculture Brooke Rollins posted on X that &#8220;Democrats are running out of excuses. OPEN. THE. GOVERNMENT.&#8221;<\/p>\r\n<p>States typically load SNAP funds onto recipients\u2019 debit cards on the first day of the month. Katie Hobbs, a Democrat, said she won\u2019t do that.<\/p>\r\n<p>\u00a0\u201cI don\u2019t have a pot of money just sitting there to fill these gaps,\u201d she told reporters during an appearance in Phoenix.<\/p>\r\n<p>Sens. Mark Kelly and Ruben Gallego joined other Democratic senators in pressing Rollins last week to release the contingency funds, warning that \u201cAmericans are already struggling with the rising cost of groceries and cannot afford a sudden lapse in grocery assistance.\u201d\u00a0<\/p>\r\n<p>Mayes, implicitly criticizing the governor, pointed to the state\u2019s <a href=\"https:\/\/www.azjlbc.gov\/26baseline\/492.pdf\">$1.6 billion<\/a> \u201crainy day fund\u201d and said she is \u201cunderwhelmed\u201d by the state response to an impending food security crisis.\u00a0<\/p>\r\n<p>Hobbs, she said, should deploy the National Guard to assist food banks, a move California Gov. Gavin Newsom has made. Mayes also said the governor should call a special session so the Legislature can authorize funding to keep SNAP going as the lawsuit plays out.\u00a0<\/p>\r\n<p>\u201cWe need to be doing everything that we can do, in addition to this lawsuit, to get ready for the tsunami of cruelty and chaos that is coming at our families in just a few days,\u201d Mayes said.<\/p>\r\n<p>Amy Schwabenlender, CEO of Keys for Change, which addresses homelessness in Maricopa County, said Monday that she\u2019s worried that if food aid is frozen, people will be forced to choose between housing and hunger.<\/p>\r\n<p>\u201cWe know people need SNAP\u201d and other programs, she said, \u201cand when one of those things are cut, it makes it more challenging,\u201d adding that the uncertainty is maddening. \u201cThere\u2019s so much need.\u201d<\/p>\r\n<p>On a corner near the Key Campus, an unhoused woman, Brandy Baker, said she gets about $60 a month through SNAP and it\u2019s not nearly enough.
