Photo: Cherokee Nation<\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">U.S. Supreme Court Breaks Sacred Vow to Oklahoma Tribal Nations<\/div>\r\n<div class=\"date\">Tuesday, July 5, 2022<\/div>\r\n<div class=\"byline\">By Principal Chief Chuck Hoskin Jr. <A href=\"https:\/\/twitter.com\/ChuckHoskin_Jr\"><I aria-hidden=true class=\"fab fa-twitter\"><\/I><\/A><\/div>\r\n<div class=\"source\">Cherokee Nation<\/div>\r\n<div class=\"source-links\"><A \r\nhref=\"https:\/\/www.cherokee.org\/\">cherokee.org<\/A><\/div>\r\n<P><\/P>\r\nThe United States Supreme Court\u2019s <a href=https:\/\/anadisgoi.com\/index.php\/government-stories\/983-statement-from-cherokee-nation-principal-chief-on-supreme-court-decision-in-oklahoma-v-castro-huerta>disconcerting decision in <em>Oklahoma v. Castro-Huerta<\/em><\/a> will go down in history as a ruling against legal precedent and the basic principles of federal Indian law.\r\n<P><\/P>\r\nTragically, it is another broken promise from the federal government to tribes. A narrow 5-4 majority of the Supreme Court has ignored its sacred responsibility to uphold the law when it comes to federal treaties with Native sovereign nations.\r\n <P><\/P>\r\nIn <em>Castro-Huerta<\/em>, the court sided with Oklahoma\u2019s claim that it can prosecute certain crimes committed against Indian citizens on Indian reservations. That claim goes against decades of precedents and laws, not just in Oklahoma but across the United States.\r\n <P><\/P>\r\n<div class=\" content_cards_card content_cards_domain_twitter-com\">\n\t\t\t<div class=\"content_cards_image\">\n\t\t\t\t<a class=\"content_cards_image_link\" href=\"https:\/\/twitter.com\/indianz\/status\/1542183060942241793\">\n\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2026\/06\/20\/qwsf8fwm_200x200-1.jpg\" alt=\"indianz.com (@indianz) on X\">\t\t\t\t<\/a>\n\t\t<\/div>\n\t\n\t<div class=\"content_cards_title\">\n\t\t<a class=\"content_cards_title_link\" href=\"https:\/\/twitter.com\/indianz\/status\/1542183060942241793\">\n\t\t\tindianz.com (@indianz) on X\t\t<\/a>\n\t<\/div>\n\t<div class=\"content_cards_description\">\n\t\t<a class=\"content_cards_description_link\" href=\"https:\/\/twitter.com\/indianz\/status\/1542183060942241793\">\n\t\t\t<p>&#8220;The U.S. Supreme Court ruled against legal precedent and the basic principles of congressional authority and Indian law&#8221;: Cherokee Nation Chief @ChuckHoskin_Jr reacts to #SupremeCourt decision in #TribalSovereignty case. #HonorTheTreaties @CherokeeNation https:\/\/t.co\/JgGVYwGdSl<\/p>\n\t\t<\/a>\n\t<\/div>\n\t<div class=\"content_cards_site_name\">\n\t\t<img decoding=\"async\" src=\"https:\/\/twitter.com\/favicon.ico\" alt=\"X (formerly Twitter)\" class=\"content_cards_favicon\"\/>\t\tX (formerly Twitter)\t<\/div>\n<\/div>\r\n<P><\/P>\r\nWe know this decision is a betrayal to our sovereign nations in Oklahoma, and it will have far reaching impacts on all federally-recognized tribes. Justice Neil Gorsuch said it best in his dissenting opinion, \u201cthis Court once stood firm, today it wilts.\u201d During arguments, Justice Gorsuch asked if the Court would \u201cwilt today because of a social media campaign.\u201d That answer, sadly was yes. \r\n<P><\/P><div class=h5>\r\nAs Justice Gorsuch wrote, \u201cTruly, a more ahistorical and mistaken statement of Indian law would be hard to fathom.\u201d<\/div>\r\n <P><\/P>\r\nStill, the Court has refused to overturn its <a href=https:\/\/indianz.com\/News\/2020\/07\/09\/on-the-far-end-of-the-trail-of-tears-nat.asp>2020 <em>McGirt<\/em> decision<\/a>, despite Governor Kevin Stitt\u2019s prolonged and deceitful effort to attack tribal sovereignty and paint a blatantly false picture of chaos. We have worked with all state, local and federal partners who are willing to work with us to meet our public safety responsibilities. We all have the same goal of protecting people.\r\n <P><\/P>\r\nGoing forward into a new chapter of concurrent jurisdiction, tribes will continue to seek partnership with state authorities while expanding our own justice systems. We hope that with these legal questions behind us, Governor Stitt will finally lay his anti-tribal agenda to rest and come to the table to move forward with us \u2013 for the sake of Oklahomans and public safety.\r\n <P><\/P>\r\nWhile we are disheartened by this ruling, we will not back off from our obligation to protect our people and all Oklahomans within the 7,000-square-mile Cherokee Nation Reservation. From the beginning we have sought to work together with Oklahoma and the federal government, and nothing about that has changed. They built and rebuilt a great Cherokee Nation despite attempts to erase us. Prior to being elected Principal Chief, Hoskin served as the tribe\u2019s \r\nSecretary of State.
