Artwork by Art Lien<\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">Divided court rejects Texas\u2019 bid to control gambling in tribal casinos<\/div>\r\n<div class=\"date\">Monday, June 20, 2022<\/div>\r\n<div class=\"byline\">By Ronald Mann<\/div>\r\n<div class=\"source\">SCOTUSblog<\/div>\r\n<div class=\"source-links\"><a href=https:\/\/www.scotusblog.com\/>scotusblog.com<\/a><\/div>\r\n<P><\/P>\r\nLast Wednesday\u2019s <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2022\/06\/15\/20-493_jgko.pdf\">decision<\/a> in <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/ysleta-del-sur-pueblo-v-texas\/\"><em>Ysleta del Sur Pueblo v. Texas<\/em><\/a> resolves a longstanding dispute about the ability of Texas to control gambling on the lands of two of the Native American tribes that reside there. The answer the court gave was a stern rebuke, vitiating the plenary control that lower-court decisions had granted the state for more than a quarter of a century.<P><\/P>\r\nThe problem involves the odd history of two of the three Native American tribes that remain in the state of Texas, the petitioner Ysleta del Sur Pueblo (a tiny reservation near El Paso) and the much larger Alabama-Coushatta reservation in East Texas. Although almost all Native American tribes in the United States operate under a trust relationship with the federal government, those two tribes were in a trust relationship with Texas from 1968 to 1987. When Texas authorities decided that their state constitution did not permit that relationship, Congress restored a federal trust relationship for those tribes by passing the <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/STATUTE-101\/pdf\/STATUTE-101-Pg666.pdf\">Restoration Act<\/a> in 1987. The most controversial provisions of that statute, addressed in <em>Ysleta<\/em>, are the provisions that govern the tribes\u2019 subjection to Texas gambling regulations.<P><\/P>\r\nThe basic problem is how to reconcile one provision, which bars gambling activity \u201cprohibited\u201d by Texas law, with another provision, stating that the statute is not \u201ca grant of civil or criminal regulatory jurisdiction to the State of Texas.\u201d The lower courts quickly allowed Texas to act under those provisions to subject tribal operations to the full range of its regulations. In this case, for example, the state successfully challenged the operation of bingo by the Pueblo that does not follow the details of Texas\u2019 regulations on that subject. Justice Neil Gorsuch\u2019s opinion for the court squarely rejects that understanding.<P><\/P>\r\n<div class=\" content_cards_card content_cards_domain_indianz-com\">\n\t\t\t<div class=\"content_cards_image\">\n\t\t\t\t<a class=\"content_cards_image_link\" href=\"https:\/\/indianz.com\/News\/2022\/06\/15\/supreme-court-strikes-back-at-state-in-long-running-tribal-sovereignty-dispute\/\">\n\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2026\/06\/15\/speakingrockentertainmentcenter-scaled-6.jpg\" alt=\"Supreme Court strikes back at state in long-running tribal sovereignty dispute\">\t\t\t\t<\/a>\n\t\t<\/div>\n\t\n\t<div class=\"content_cards_title\">\n\t\t<a class=\"content_cards_title_link\" href=\"https:\/\/indianz.com\/News\/2022\/06\/15\/supreme-court-strikes-back-at-state-in-long-running-tribal-sovereignty-dispute\/\">\n\t\t\tSupreme Court strikes back at state in long-running tribal sovereignty dispute\t\t<\/a>\n\t<\/div>\n\t<div class=\"content_cards_description\">\n\t\t<a class=\"content_cards_description_link\" href=\"https:\/\/indianz.com\/News\/2022\/06\/15\/supreme-court-strikes-back-at-state-in-long-running-tribal-sovereignty-dispute\/\">\n\t\t\t<p>The days of state governments claiming special authority over Indian Country appear to be numbered, with the nation\u2019s highest court issuing another favorable ruling for tribal interests.<\/p>\n\t\t<\/a>\n\t<\/div>\n\t<div class=\"content_cards_site_name\">\n\t\t<img decoding=\"async\" src=\"https:\/\/www.indianz.com\/favicon.ico\" alt=\"Indianz.Com\" class=\"content_cards_favicon\"\/>\t\tIndianz.Com\t<\/div>\n<\/div>\r\n<P><\/P>\r\nFor Gorsuch, \u201cthe most striking feature about th[e statutory] language is its dichotomy between prohibition and regulation.\u201d Specifically, as he puts it, the first provision \u201csays that gaming activities <em>prohibited<\/em> by state law are also prohibited as a matter of federal law (using some variation of the word \u2018prohibited\u2019 no fewer than three times).\u201d Conversely, the second provision \u201cinsists that the statute does not grant Texas civil or criminal <em>regulatory<\/em> jurisdiction with respect to \u2026 gaming.\u201d<P><\/P>\r\nGorsuch starts with \u201ca careful look at the statute\u2019s terms standing on their own.\u201d Quoting from an assortment of dictionaries, he suggests that \u201cto <em>prohibit<\/em> something means to \u2018forbid,\u2019 prevent,\u2019 or \u2018effectively stop\u2019 it, or \u2018make [it] impossible.\u2019\u201d In contrast, dictionaries that he quotes suggest that \u201cto <em>regulate<\/em> something is usually understood to mean to \u2018fix the time, amount, degree, or rate\u2019 of an activity \u2018according to rule[s].\u2019\u201d<P><\/P>\r\nGorsuch sees those definitions as \u201ca problem\u201d for Texas. The dispute in this particular case involves bingo, and Texas \u201cconcedes that its laws do not forbid, prevent, effectively stop, or make bingo impossible.\u201d Bingo in fact is quite common in Texas, \u201csubject to fixed rules about the time, place, and manner in which it may be conducted.\u201d For Gorsuch, \u201cit would seem to follow that Texas\u2019s laws fall on the regulatory rather than prohibitory side of the line \u2013 and thus may not be applied on tribal lands.\u201d<P><\/P>\r\n<iframe loading=\"lazy\" width=\"100%\" height=\"300\" scrolling=\"no\" frameborder=\"no\" allow=\"autoplay\" src=\"https:\/\/w.soundcloud.com\/player\/?url=https%3A\/\/api.soundcloud.com\/tracks\/1220684977&#038;color=%23ff5500&#038;auto_play=false&#038;hide_related=false&#038;show_comments=true&#038;show_user=true&#038;show_reposts=false&#038;show_teaser=true&#038;visual=true\"><\/iframe> \r\n<figcaption class=\"figure-caption\">Indianz.Com Audio: <a href=\"https:\/\/indianz.com\/News\/2022\/02\/22\/supreme-court-audio-ysleta-del-sur-pueblo-v-texas\/\" title=\"Ysleta del Sur Pueblo v. Texas<\/a><\/figcaption>\r\n<p><\/p>\r\nGorsuch acknowledges Texas\u2019 textual argument \u2013 \u201cin everyday speech someone could describe its laws as \u2018prohibiting\u2019 bingo <em>unless<\/em> the State\u2019s time, place, and manner regulations are followed.\u201d Gorsuch offers several responses. Most prominently, he says, \u201cit risks rendering the Restoration Act a jumble.\u201d For Gorsuch, it is plain \u2013 \u201c[n]o one questions\u201d \u2013 \u201cthat Texas \u2018regulates\u2019 bingo by fixing the time, place, and manner in which the game may be conducted.\u201d So if the court accepts that \u201cin some sense\u201d Texas also prohibits bingo, \u201cthe law\u2019s dichotomy between prohibition and regulation collapses\u201d because \u201c[l]aws regulating gaming activity <em>become<\/em> laws prohibiting gambling activities.\u201d From that point, Gorsuch reasons that acceptance of Texas\u2019 argument would leave the bar on regulatory jurisdiction \u201cwith no work to perform, its terms dead letters all.\u201d<P><\/P>\r\nPerhaps more devastating are the \u201ccontextual clues\u201d Gorsuch discusses in the next section of the opinion. First is the Supreme Court\u2019s 1987 decision in <a href=\"https:\/\/casetext.com\/case\/california-v-cabazon-band-of-mission-indians\"><em>California v. Cabazon Band of Mission Indians<\/em><\/a>, which distinguished between types of gambling that a state prohibits outright (craps, for example) and those that it permits subject to regulation (bingo, in the <em>Cabazon<\/em> example, \u201claws materially identical to the Texas bingo laws before us today\u201d). In <em>Cabazon<\/em>, interpreting a regulatory regime for Native American reservations that does not apply under the Restoration Act, the court held that California could regulate the gambling it prohibited outright, but, crucially, that it could not regulate gambling like bingo that it permits on specified terms and conditions. \u201cFor us, [<em>Cabazon<\/em>] clinches the case.\u201d Because <em>Cabazon<\/em> \u201cwas not only <em>a<\/em> relevant precedent concerning Indian gaming; it was <em>the<\/em> precedent, \u2026. [w]e do not see how we might fairly read the terms of the Restoration Act except in the same light.\u201d<P><\/P>\r\nAlthough Gorsuch describes the case as clinched, he goes further to emphasize two other statutes contemporaneous with the Restoration Act. One, adopted the same day as the Restoration Act, subjected a tribe to \u201cthose laws and regulations which <em>prohibit or regulate<\/em> the conduct of bingo or any other game of chance.\u201d Another, adopted \u201c[s]hortly after the Restoration Act,\u201d provided that \u201call laws \u2026 <em>and regulations of the State<\/em> \u2026 <em>shall govern the regulation of<\/em> gambling \u2026 by the Tribe on and off the Reservation.\u201d For Gorsuch, the choice \u201cto use the language of <em>Cabazon<\/em> in different ways in three statutes closely related in time and subject matter [is] too much to ignore.\u201d<P><\/P><div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><P><\/P>\r\nThe opinion includes several more pages rejecting a variety of historical and policy arguments that Texas advanced, but the foregoing should give an adequate understanding of the motivation of Gorsuch\u2019s opinion. To put the decision in context, it probably is not a coincidence that the 5-4 lineup parallels the lineup in the court\u2019s most important Native American case of the millennium, <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/mcgirt-v-oklahoma\/\"><em>McGirt v. Oklahoma<\/em><\/a>, which recognized a reservation continuing to cover the eastern half of Oklahama.\r\n<P><\/P>\r\n The only difference is that, in <em>McGirt<\/em>, the late Justice Ruth Bader Ginsburg joined Gorsuch\u2019s majority opinion. Now, Ginsburg\u2019s successor, Justice Amy Coney Barrett, has joined Gorsuch and the three remaining liberal justices in <em>Ysleta<\/em>. The dissenters have remained the same in both cases: Chief Justice John Roberts and Justices Clarence Thomas, Samuel Alito, and Brett Kavanaugh. \r\n<P><\/P>\r\nTime will tell if the stability of the cross-ideological <em>Ysleta<\/em> majority presages a broader recognition of protections for Native Americans than the cases of the past several decades have seen. The next big clue will come in the next few weeks when the court decides <em><a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/oklahoma-v-castro-huerta\/\">Oklahoma v.
