Still, in 2015 the <a href=\"https:\/\/www.gao.gov\/products\/gao-15-588\">Government Accountability Office<\/a> reported only 12% to 15% of IHS contracts went to Indian-owned businesses, and it suggested sweeping reform is needed to increase contract opportunities.<P><\/P>\r\nSen. John Hoeven, R-N.D., sponsored the <a href=\"https:\/\/www.indian.senate.gov\/news\/press-release\/chairman-hoeven-congress-approves-hoeven-legislation-increase-economic\">Indian Community Economic Enhancement Act of 2020<\/a>, which amended three federal economic laws. It requires the IHS and BIA to create a uniform approach to Buy Indian Act procurement procedures to &#8220;reduce red tape that limits Indian business promotion.&#8221; The bill also expanded access to capital for tribes and increased opportunities for Native business promotion.<P><\/P>\r\n<div class=\" content_cards_card content_cards_domain_twitter-com\">\n\t\t\t<div class=\"content_cards_image\">\n\t\t\t\t<a class=\"content_cards_image_link\" href=\"https:\/\/twitter.com\/IHSgov\/status\/1481703849899536384\">\n\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/pbs.twimg.com\/media\/FJARo03XwAEkEgB?format=webp&#038;name=large\" alt=\"Indian Health Service (@IHSgov) on X\">\t\t\t\t<\/a>\n\t\t<\/div>\n\t\n\t<div class=\"content_cards_title\">\n\t\t<a class=\"content_cards_title_link\" href=\"https:\/\/twitter.com\/IHSgov\/status\/1481703849899536384\">\n\t\t\tIndian Health Service (@IHSgov) on X\t\t<\/a>\n\t<\/div>\n\t<div class=\"content_cards_description\">\n\t\t<a class=\"content_cards_description_link\" href=\"https:\/\/twitter.com\/IHSgov\/status\/1481703849899536384\">\n\t\t\t<p>The Indian Health Service is announcing the final rule on the Buy Indian Act to strengthen requirements to set aside contracts for Indian-owned and controlled businesses. Read more: https:\/\/t.co\/a8DfLkNcKJ #NativeHealth #IndianCountry<\/p>\n\t\t<\/a>\n\t<\/div>\n\t<div class=\"content_cards_site_name\">\n\t\t<img decoding=\"async\" src=\"https:\/\/twitter.com\/favicon.ico\" alt=\"X (formerly Twitter)\" class=\"content_cards_favicon\"\/>\t\tX (formerly Twitter)\t<\/div>\n<\/div>\r\n<p><\/P>\r\nOn January 13, the IHS released its <a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/01\/13\/2021-28156\/acquisition-regulations-buy-indian-act-procedures-for-contracting\">final rule<\/a> on the Buy Indian Act in response to the <a href=\"https:\/\/www.bia.gov\/as-ia\/raca\/regulations-development-andor-under-review\/buy-indian-act\">BIA&#8217;s<\/a> final rule, which was released in December. The <a href=https:\/\/www.ihs.gov\/newsroom\/factsheets\/buy-indian-act\/>IHS said benefits of its final rule include expanding the Buy Indian Act<\/a> to include all construction and removing regulatory burdens by allowing Indian economic enterprises to increase subcontracts,  removing construction restrictions for the enterprises and clarifying the language of the act and its procedures. <P><\/P>\r\nOklahoma tribal leaders say the new regulations could provide the economic boost they&#8217;ve been seeking. <P><\/P>\r\n&#8220;These new provisions are a step in the right direction, and I believe many tribes, including our business arm, may want to take advantage of the opportunity,&#8221; said Chuck Hoskin Jr., principal chief of the  Cherokee Nation.<P><\/P>\r\nHoskins said updated Buy Indian Act procedures will energize Native businesses. One of the largest updates <a href=\"https:\/\/www.bia.gov\/as-ia\/raca\/regulations-development-andor-under-review\/buy-indian-act\">expands the act over all construction<\/a>, including health care facilities, personnel quarters, water supply and waste disposal facilities. In northeastern Oklahoma, the nation and its businesses make an annual economic impact of $2.16 billion. <P><\/P>\r\nThe IHS&#8217;s final rule is expected to generate <a href=\"https:\/\/www.jdsupra.com\/legalnews\/indian-health-service-releases-final-2695103\/\">$200 million in contract opportunities<\/a>, a huge leap from last year&#8217;s yield of $55.9 million. <P><\/P>\r\nChoctaw Nation Chief Gary Batton said he is &#8220;pleased with the IHS&#8217;s commitment to providing economic opportunities for Indian-owned and controlled businesses.&#8221; <P><\/P>\r\nThe anticipated revenue increase is expected to come from &#8220;set-aside procurement contracts,\u201d which would prioritize Indian-owned and controlled businesses for BIA and IHS government contracts. The new rules from the IHS would also create more opportunities for non-tribal businesses to partner with tribal businesses. A tribally-owned business is any that is <a href=\"https:\/\/www.lexology.com\/library\/detail.aspx?g=736edfe4-76a1-4a61-87df-c92d8be8dc1a\">at least 51% owned<\/a> by an Indian tribe. <P><\/P>\r\n&#8220;The Buy Indian Act&#8217;s improved regulations will help our <a href=\"https:\/\/choctawsmallbusiness.com\/\">Chahtapreneurs<\/a> (Choctaw business owners) and our tribally-owned businesses to expand and grow, ultimately helping our tribe and its members to thrive,&#8221; Batton said. <P><\/P>\r\nThe <a href=\"https:\/\/www.choctawnation.com\/business\">Choctaw Nation&#8217;s website<\/a> states that Choctaw businesses &#8220;generate hundreds of millions of dollars annually&#8221; and &#8220;create more than 6,000 jobs for tribal and non-tribal Oklahomans.&#8221; The revenue generated by the tribe is dedicated to tribal assistance programs such as health care and education.  <P><\/P><div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><p><\/p>In 2020, Harvard researchers estimated that Native businesses could lose up to <a href=\"https:\/\/www.americanprogress.org\/article\/covid-19-response-indian-country\/\">$50 billion<\/a> during COVID-19, and 1.1 million tribal business workers \u2013 Native and non-Native \u2013 could lose their jobs. With IHS and BIA prioritizing Buy Indian set-asides instead of businesses that are not Indian economic enterprises, Native companies and employees could see a chance to recoup from pandemic-related economic losses.  <P><\/P>\r\nThe IHS&#8217;s final rule is set to go into effect on March 14.
