Photo: <a href=https:\/\/www.flickr.com\/photos\/whitehouse\/50397745836\/> Amy Rossetti \/ White House<\/a>\r\n<\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">Supreme Court opens new session amid COVID-19 and controversy<\/div>\r\n<div class=\"date\">Tuesday, October 6, 2020<\/div>\r\n<div class=\"byline\">By Acee Agoyo<\/div>\r\n<div class=\"source\">Indianz.Com<\/div>\r\n<p><\/p>\r\nAmid growing uncertainty due to the <a href=\/covid19\/>COVID-19 pandemic<\/a>, the <a href=https:\/\/www.supremecourt.gov\/>U.S. Supreme Court<\/a> opened its new term on Monday, as Republicans remain intent on confirming a conservative <a href=https:\/\/indianz.com\/News\/2020\/09\/28\/republicans-rush-to-confirm-supreme-court-nominee-ahead-of-election\/>judge with virtually no experience in Indian law <\/a> to the nation&#8217;s highest judicial body.\r\n<p><\/p>\r\nEven though two GOP members of the <a href=https:\/\/www.judiciary.senate.gov\/>Senate Committee on the Judiciary<\/a> have tested positive for COVID-19, the disease caused by the coronavirus, the panel&#8217;s <a href=https:\/\/www.judiciary.senate.gov\/press\/rep\/releases\/no-change-to-senate-judiciary-committee-supreme-court-nomination-hearing>Republican leader still plans<\/a> to hold a confirmation hearing for <a href=https:\/\/en.wikipedia.org\/wiki\/Amy_Coney_Barrett>Judge Amy Coney Barrett<\/a> next Monday as planned. The rush to move forward drew a sharp condemnation from <a href=https:\/\/www.tomudall.senate.gov\/>Sen. Tom Udall<\/a> (D-New Mexico), the vice chairman of the <a href=https:\/\/indian.senate.gov\/>Senate Committee on Indian Affairs<\/a>, who said tribal concerns aren&#8217;t being taken into account.\r\n<p><\/p>\r\n\u201cInstead of pushing a partisan nomination process through the Senate during a critical moment in our country\u2019s history, Senate Republicans should respect the federal government\u2019s duty\u2014and trust obligation\u2014to engage in meaningful tribal consultation on the impact this vital nominee will have on Indian Country\u2019s future,\u201d  said Udall, who is retiring at the end of the current legislative session. \u201cThey must stop putting partisan politics ahead of our core democratic principles and let the American people decide who nominates the next Supreme Court justice.\u201d \r\n<p><\/p>\r\nBut with Democrats outnumbered in the <a href=https:\/\/www.senate.gov\/>U.S. Senate<\/a>, there appears to be little they can do to stop Barrett  from advancing. The two Judiciary members who tested positive &#8212;  <a href=https:\/\/www.indianz.com\/covid19\/2020\/10\/04\/sen-mike-lee-r-utah\/>Sen. Mike Lee<\/a> (R-Utah) and <a href=https:\/\/www.indianz.com\/covid19\/2020\/10\/04\/sen-thom-tillis-r-north-carolina\/>Sen. Thom Tillis<\/a> (R-North Carolina) &#8212;   are cutting their coronavirus quarantines short in order to be in Washington for an anticipated committee vote  on the nomination.\r\n<P><\/p>\r\nWithout Lee and Tillis present, Republicans might not be able to move forward with Barrett. The GOP holds 12 seats on the committee, compared to 10 for the Democrats, so every vote counts.\r\n<p><\/p>\r\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">Republicans should end their attempt to force through a <a href=\"https:\/\/twitter.com\/hashtag\/SCOTUS?src=hash&amp;ref_src=twsrc%5Etfw\">#SCOTUS<\/a> nominee with dangerous implications for all Native communities. The GOP quest to destroy the Affordable Care Act would throw the IHS into chaos &amp; jeopardize Native communities\u2019 work to fight COVID-19. <a href=\"https:\/\/twitter.com\/hashtag\/WhatsAtStake?src=hash&amp;ref_src=twsrc%5Etfw\">#WhatsAtStake<\/a> <a href=\"https:\/\/t.co\/Tp7dOsviWN\">https:\/\/t.co\/Tp7dOsviWN<\/a><\/p>&mdash; Tom Udall (@SenatorTomUdall) <a href=\"https:\/\/twitter.com\/SenatorTomUdall\/status\/1313218519081848836?ref_src=twsrc%5Etfw\">October 5, 2020<\/a><\/blockquote> <script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\r\n<p><\/p>\r\nAnd should the committee approve Barrett following the <a href=https:\/\/www.judiciary.senate.gov\/press\/rep\/releases\/chairman-graham-announces-hearing-dates-for-judge-barretts-supreme-court-nomination>confirmation hearing<\/a>, Democrats likely won&#8217;t be able to stop a final vote on the Senate floor, as it only takes a simple majority to confirm a judicial nominee. Republicans hold 53 seats in the chamber, enabling them to easily confirm hundreds of judges to courts that make decisions affecting tribal nations and their citizens.\r\n<P><\/P>\r\n\u201cAs vice chairman of the Senate Committee on Indian Affairs, and as the senator representing 23 Pueblos and Tribes of New Mexico in Congress, I believe that Judge Amy Coney Barrett\u2019s confirmation would have dangerous implications for Indian Country,\u201d said Udall.\r\n<p><\/p>\r\nUdall was referring specifically to a Republican-led case against the <a href=https:\/\/en.wikipedia.org\/wiki\/Affordable_Care_Act>Affordable Care Act<\/a> (ACA). Repealing the ACA would undo the <a href=https:\/\/www.ihs.gov\/ihcia\/>Indian Health Care Improvement Act<\/a>, which tribes fought hard to reauthorize in 2010, overcoming years of opposition from GOP members of Congress, as well as  from the <a href=https:\/\/indianz.com\/News\/2017\/11\/13\/president-trump-taps-bushera-official-as.asp>Republican George W. Bush administration<\/a>.\r\n<P><\/p>\r\nUndoing the ACA would also eliminate other <a href=\"https:\/\/indianz.com\/News\/2020\/09\/28\/montana-free-press-affordable-care-act-deemed-essential-for-indian-country\/\" title=\"Montana Free Press: Affordable Care Act deemed essential for Indian Country\">provisions that have benefited the first Americans<\/a> and the care they receive from the <a href=https:\/\/www.ihs.gov\/>Indian Health Service<\/a>. Texas<\/em><\/a>, also known as <em>Texas v. U.S.<\/em>, Indian Country has been closely watching the Supreme Court, especially in light of the  passing of <a href=https:\/\/en.wikipedia.org\/wiki\/Ruth_Bader_Ginsburg>Justice Ruth Bader Ginsburg<\/a> last month. Though she had a mixed record when it comes to tribal interests, her death created a vacancy on the high court that will difficult to fill, leaders and advocates have asserted\r\n<p><\/p>\r\n\u201cJustice Ginsburg was a true trailblazer,\u201d <a href=https:\/\/twitter.com\/stephenroelewis?lang=en>Governor Stephen Roe Lewis<\/a> of the <a href=http:\/\/www.gilariver.org\/>Gila River Indian Community<\/a> said on the day following her passing on September 18 at the age of 87. \u201cShe broke barriers and made sure there was a path for others to follow.\u201d\r\n<p><\/p>\r\nPrior to her passing, Ginsburg joined a narrow majority of the court in <a href=https:\/\/indianz.com\/News\/2020\/07\/09\/on-the-far-end-of-the-trail-of-tears-nat.asp>siding with  tribal interests in <Em>McGirt v. Oklahoma<\/em><\/a>. By a 5 to 4 vote, the court held that the reservation on the <a href=https:\/\/www.mcn-nsn.gov\/>Muscogee (Creek) Nation<\/a>, which was guaranteed by treaty, continues to exist in Oklahoma.\r\n<P><\/P>\r\n\u201cJustice Ginsburg\u2019s opinions did not always align with the view tribal nations maintain when it comes to unique trust relationships we have with the federal government,\u201d observed Seth Damon, the Speaker of the <a href=http:\/\/www.navajonationcouncil.org\/>Navajo Nation Council<\/a>, the legislative branch of the <a href=http:\/\/www.navajo-nsn.gov\/>Navajo Nation<\/a>. \u201cBut it is those opinions that strengthen decisions relating to our ability to exist as a nation within a nation.\u201d\r\n<P><\/P>\r\nSo far, the Supreme Court doesn&#8217;t have any Indian law cases on its docket. On Monday, the first day of the October 2020 term, the justices denied petitions in three matters that were being <a href=https:\/\/sct.narf.org\/termindexes\/october2020>monitored by tribes and their advocates<\/a>.\r\n<p><\/p><div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><p><\/p>\r\n<div class=\"h5-responsive sub\"><EM>In Re Scott Louis Youngbear<\/EM><\/div>\r\nScott Louis YoungBear, a citizen of the <a href=https:\/\/meskwaki.org\/>Meskwaki Nation<\/a>, sought review of an Iowa Supreme Court decision in which he challenged his continued placement on the state&#8217;s sex offender registry. He raised issues of  religious freedom, constitutional rights and tribal sovereignty in a petition he submitted himself to the U.S. Supreme Court.\r\n<p><\/p>\r\nThe state of Iowa waived its right to respond to <a href=https:\/\/sct.narf.org\/caseindexes\/in_re_youngbear.html><EM>In Re Scott Louis Youngbear<\/EM><\/a>. In an <a href=https:\/\/indianz.com\/News\/wp-content\/uploads\/2020\/10\/100520zor_3204.pdf>order list on Monday<\/a>, the justices  declined the petition without comment.\r\n<P><\/P>\r\n<div class=\"h5-responsive sub\"><em>Native Wholesale Supply Company v. California, ex rel. Xavier Becerra<\/em>  <\/div>\r\nNative Wholesale Supply Company, a business that was started by a citizen of the <a href=https:\/\/sni.org\/>Seneca Nation<\/a>, sued the state of California  in connection with the sale of  tobacco to the <a href=https:\/\/www.bigsandyrancheria.com\/>Big Sandy Rancheria Band of Mono Indians<\/a>.\r\n<p><\/p>\r\nIn a <a href=https:\/\/turtletalk.blog\/tag\/people-ex-rel-becerra-v-native-wholesale-supply\/>July 2019 decision<\/a>, an appeals court in California held Native Wholesale liable for violating state laws. The ruling  stands following the Supreme Court&#8217;s rejection of the petition in \r\n<a href=https:\/\/sct.narf.org\/caseindexes\/native_wholesale_v_ca.html><em>Native Wholesale Supply Company v. California, ex rel. North Carolina<\/em> <\/div>\r\nGeorge Lee Nobles it not a citizen of the <a href=https:\/\/ebci.com\/>Eastern Band of Cherokee Indians<\/a> but his mother is enrolled in the tribe. As such, he is considered a \u201cfirst descendant\u201d and is entitled to receive certain services from the tribal government. He also lived on and near the reservation in North Carolina for his entire life. He was even employed by the tribe for a time.\r\n<P><\/P>\r\nBut Nobles is not an \u201cIndian,\u201d according to a <a href=https:\/\/turtletalk.blog\/tag\/state-v-nobles\/>March 2020 decision<\/a> from the North Carolina Supreme Court. The ruling cited his lack of participation in certain aspects of tribal life and noted that he \u201cdid not hold himself out as an Indian.\u201d\r\n<p><\/p>\r\nAs a result, the state court asserted authority over Nobles for a murder and robbery committed on the reservation. Two co-defendants, on the other hand, were subject to tribal jurisdiction because one was an Eastern Cherokee citizen while the other was a <a href=https:\/\/www.cherokee.org\/>Cherokee Nation<\/a> citizen. Under federal law, an \u201cIndian\u201d defendant could also be subject to the Major Crimes Act for crimes committed in Indian Country.\r\n<P><\/p>\r\nIn his petition, Nobles noted that the North Carolina court system  \u201cfaulted him for having tattoos &#8212; an eagle and an Indian headdress &#8212; that are too generically Indian and not closely enough connected to the Eastern Band of Cherokee Indians in particular.\u201d \r\n<P><\/p>\r\n\u201cWhen a person is part Indian and part non-Indian, a test that allows courts to weigh every aspect of his life will allow courts to reach either result in almost any case,\u201d the petition said in highlighting the seemingly arbitrary nature of how the North Carolina courts determine who is \u201cIndian\u201d and who is not.\r\n<p><\/p>\r\nThe state of North Carolina  waived its right to respond to <a href=https:\/\/sct.narf.org\/caseindexes\/nobles_v_north_carolina.html><em>Nobles v. North Carolina<\/em><\/a>. In an order list on Monday,  justices  declined the petition without comment.\r\n<P><\/P>\r\n<div class=\"embed-responsive embed-responsive-16by9\">\r\n                        <iframe src=\"https:\/\/www.youtube.com\/embed\/q6J2ikBIya0\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen><\/iframe>\r\n                    <\/div>\r\n                    <figcaption class=\"figure-caption\">\r\n                        Indianz.Com Video: \r\n                        <a href=https:\/\/youtu.be\/q6J2ikBIya0>Chairman of Crow Tribe | Donald Trump  | Republicans #NativeVote20<\/a>\r\n                    <\/figcaption>\r\n<p><\/p>\r\n<div class=\"h5-responsive sub\">Still on the watch<\/div>\r\nThe <a href=https:\/\/sct.narf.org\/index.html>Tribal Supreme Court Project<\/a>, a joint initiative of the <a href=http:\/\/www.ncai.org\/>National Congress of American Indians<\/a> and the <a href=https:\/\/www.narf.org\/>Native American Rights Fund<\/a>, is monitoring four pending petitions.  One of them is garnering wide  interest.\r\n<P><\/P>\r\nAt issue in <a href=https:\/\/sct.narf.org\/caseindexes\/us_v_cooley.html><em>United States v. Cooley<\/em><\/a> is whether a tribal police officer had the authority to stop and detain a non-Indian  on a public road on the Crow Reservation in Montana. During the stop, evidence of methamphetamine trafficking was uncovered, leading to federal charges  against James Cooley.\r\n<p><\/p>\r\nIn a <a href=https:\/\/turtletalk.blog\/2019\/03\/21\/ninth-circuit-holds-exclusionary-rule-applies-to-evidence-obtained-in-violation-of-icras-fourth-amendment-counterpart\/>March 2019 decision that took almost a year<\/a> to render, the  <a href=https:\/\/www.ca9.uscourts.gov\/>9th Circuit Court of Appeals<\/a>  ruled that the the tribal officer was  wrong for failing to ascertain the defendant&#8217;s \u201cIndian\u201d status despite searching his vehicle twice during the stop. The ruling  &#8212; if it stands &#8212; allows  the evidence gathered against Cooley to be suppressed, thus derailing the charges against him in a state where meth has been a scourge in Indian Country.\r\n<p><\/p>\r\nThe decision  has drawn  dire warnings   from a broad range of interests. The <a href=https:\/\/www.ca9.uscourts.gov\/>Crow Tribe<\/a>, the   <a href=https:\/\/www.ca9.uscourts.gov\/>National Indigenous Women&#8217;s Resource Center<\/a> (NIWRC) and even the Trump administration are calling on the Supreme Court to reverse the 9th Circuit.\r\n<P><\/p>\r\nIn a friend of the court brief joined by five tribes, the NIWRC wrote that \r\n\u201cNative women suffer the highest rates of violence in the United States, the majority of the perpetrators of these crimes are non-Indian, and many reservations contain large populations of non-Indian residents and large swaths of non-Indian fee land.\u201d\r\n<p><\/p>\r\n\u201cFor Tribal Nations who seek to protect Native women in their own homes, the Ninth Circuit&#8217;s decision is alarming,\u201d the NIWRC wrote.\r\n<P><\/P>\r\nIt&#8217;s hard to ignore the weight of the federal government yet  Cooley waived his right to respond to the petition in <a href=https:\/\/sct.narf.org\/caseindexes\/us_v_cooley.html><EM>United States v. Cooley<\/em><\/a>.  The Supreme Court has  since   ordered him  to provide a response by October 15, after which the petition will be considered again.\r\n<P><\/P>\r\n&#8226; <STRONG>US v. Less than a week later, Trump announced he tested positive for <a href=https:\/\/www.flickr.com\/photos\/whitehouse\/50397944742\/>Andrea Hanks \/ White House<\/a>\r\n<\/figcaption>\r\n<\/figure>\r\n<P><\/P>\r\n<div class=\"h5-responsive sub\">Amy Coney Barrett<\/div>\r\nThe Senate Committee on the Judiciary is scheduled to begin the <a href=https:\/\/www.judiciary.senate.gov\/press\/rep\/releases\/chairman-graham-announces-hearing-dates-for-judge-barretts-supreme-court-nomination>confirmation hearing<\/a> for Amy Coney Barrett on October 12. <a href=https:\/\/www.lgraham.senate.gov\/>Sen. Lindsey Graham<\/a> (R-North Carolina), who is seeking re-election this year, has said it will last three to four days.\r\n<p><\/p>\r\nBarrett currently serves on the  <a href=http:\/\/www.ca7.uscourts.gov\/>7th Circuit Court of Appeals<\/a> though she hasn&#8217;t decided any cases affecting tribes. Writing on the influential Turtle Talk blog, <a href=https:\/\/turtletalk.blog\/2020\/10\/02\/notes-on-the-thin-indian-law-record-of-judge-barrett\/>professor Matthew Fletcher described her Indian law  record as &#8220;thin.&#8221;<\/a>\r\n<P><\/P>\r\nShould Barrett win confirmation as an associate justice, she would be the 6th member of the Supreme Court who was nominated by a Republican president. The other three were chosen by Democratic presidents.\r\n<p><\/p>\r\nBarrett, a former professor at University of Notre Dame Law School in Indiana, located on the homelands of the Pokagon Band of Potawatomi Indians,  was introduced to the public on September 26. The  event, held  at the White House, was attended by Sen. Lee, Sen. Tillis and several others who have since tested positive for COVID-19. \r\n<p><\/p>\r\nPresident Donald Trump also tested positive following the event, and   spent three days in the hospital before being discharged on Monday evening. First Lady Melania Trump tested positive as well, as did the president of the  University of Notre Dame.\r\n<p><\/p>\r\nAccording to <a href=https:\/\/www.washingtonpost.com\/politics\/barrett-coronavirus-court-trump\/2020\/10\/02\/ecf7c7ce-04cf-11eb-8879-7663b816bfa5_story.html>The Washington Post<\/a>, Barrett recovered from a COVID-19 diagnosis over the summer.
