The land grants, often referred to as <a href=https:\/\/nmlandgrantconsejo.org\/about><em>mercedes<\/em> in the Spanish language<\/a>,  were previously issued by the kingdom of Spain and, later, by the   government of Mexico. \r\n<p><\/p>\r\nSome of the land within the <em>mercedes<\/em> has since ended up in the <a href=https:\/\/www.gao.gov\/products\/gao-01-951>hands of the United States<\/a>.  The bill addresses how federal agencies manage these areas.\r\n<p><\/p>\r\nBut while H.R.5493 attempts to ensure that the sovereign rights of tribes   aren&#8217;t impacted by this new consultation policy, the Biden administration is raising  some significant concerns. Teresa Leger Fernandez<\/a> (D-New Mexico), the sponsor of H.R.5493,   enthusiastically presented the bill   <a href=https:\/\/soundcloud.com\/indianz\/h-r-5493-rep-teresa-leger?in=indianz\/sets\/house-subcommittee-on-national-parks-forests-and-public-lands-legislative-hearing-march-1-2022>at the start of the hearing<\/a>. Land grants represent an important part of her state&#8217;s history and culture, she said, noting that even her   ancestors lived on   <em>mercedes<\/em>.\r\n<P><\/P>\r\n&#8220;New Mexicans have maintained that dedication to the land and living in the places they love,&#8221;  said Leger Fernandez, who   serves as chair of the <a href=https:\/\/naturalresources.house.gov\/subcommittees\/subcommittee-for-indigenous-peoples-of-the-united-states>House Subcommittee for Indigenous Peoples of the United States<\/a>.\r\n<p><\/p>\r\n&#8220;However, there&#8217;s also been this historic and constant struggle with the federal agencies that now have the  forests and the grazing areas, and  oftentimes even &#8211; you know &#8212;  historic cemeteries are in these now federal lands,&#8221;  said  Leger Fernandez, who is  in   her first term in the U.S. Congress.\r\n<P><\/p>\r\nBut after hearing Smith&#8217;s comments on behalf of the Biden administration, Leger Fernandez appeared to offer a concession &#8212; though not on the underlying premise of her legislation. She said she was willing to take another look at very nature  of &#8220;consultation&#8221; in the bill, in response to the concerns  about   the trust and treaty relationship.\r\n<p><\/p>\r\n&#8220;I\u2019m very open to   getting specific language, you know  codified in a sense, [of] what consultation means with regards to land grants,&#8221; Leger Fernandez said of her desire to keep working on the measure.\r\n<P><\/P><div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><p><\/p>\r\nThe USDA wasn&#8217;t the only federal agency standing up for the nation-to-nation framework at the hearing. Mark Lambrecht, the assistant director\r\nfor National Conservation Lands and Community Partnerships at the <a href=https:\/\/www.blm.gov\/>Bureau of Land Management<\/a>, also stressed the need to maintain the sanctity of tribal consultation policies.\r\n<P><\/P>\r\n&#8220;I would advise that formal consultation, government-to-government relationships is spelled out in the Constitution, federal statutes, executive orders,&#8221; Lambrecht responded  when asked by Leger Fernandez, &#8220;and it differs from, I think, what this bill seeks to establish, which is written guidance for land managers to follow for early and regular communication between federal land management agency and the land grant-<em>mercedes<\/em>.&#8221;\r\n<P><\/P>\r\nLike the USDA, Lambrecht insisted that the BLM already provides ways for land grant descendants to participate in federal management processes.\r\n<p><\/p>\r\n &#8220;That&#8217;s certainly something that we support &#8212;  conversations about historical uses or  other  interests in the land grant-<em>mercedes<\/em>  and in federal land management,&#8221; Lambrecht said. &#8220;We also advise that this is something that we&#8217;re  doing already. The group&#8217;s manager, Arturo Archuleta, testified in support of H.R.5493 at the hearing, with his testimony on Tuesday  showing how <em>mercedes<\/em> are identifying themselves as having Indian heritage.\r\n<p><\/p>\r\n&#8220;Land grant-<em>merced<\/em> communities were established between 1689 and 1854 through the granting of land from the Spanish Crown and the Mexican Government in what is now the United States\u2019 Southwest,&#8221;  <a href=https:\/\/soundcloud.com\/indianz\/arturo-archuleta-new-mexico?in=indianz\/sets\/house-subcommittee-on-national-parks-forests-and-public-lands-legislative-hearing-march-1-2022>Archuleta said after opening his presentation<\/a> with  a brief greeting in the Spanish language.\r\n<p><\/p>\r\n&#8220;Our communities were settled and populated by our <em>mestizo<\/em> and <em>gen\u00edzaro<\/em> ancestors,&#8221; Archuleta said, identifying modern-day descendants as people of mixed Indian heritage, as well as descendants of Indian people who were enslaved during the reign of the Spanish kingdom.\r\n<p><\/p>\r\nArchuleta further asserted a direct relationship between land grant heirs  and Indian people, even though Indians, generally, weren&#8217;t entitled to the same rights as <a href=https:\/\/en.wikipedia.org\/wiki\/Hispanos_of_New_Mexico><em>mestizo<\/em><\/a> or <a href=https:\/\/en.wikipedia.org\/wiki\/Gen%C3%ADzaro><em>gen\u00edzaro<\/em><\/a> residents during Spanish or Mexican rule in the Southwest. Heinrich<\/a><\/figcaption>\r\n<p><\/p>\r\nThe shift to an Indian, or mixed Indian, identity appears to be  a relatively new development for the New Mexico Land Grant Council, which receives $221,900 in taxpayer funds annually <a href=https:\/\/lgc.unm.edu\/resources>according to official reports<\/a>.  Just two years ago, when a prior version of the  consultation  bill was introduced in the House, the <a href=https:\/\/indianz.com\/News\/wp-content\/uploads\/2022\/03\/02\/nmlgc041620.pdf>group   stated  merely that land grants had been  issued<\/a> to communities that consisted of &#8220;Hispanic and Native American inhabitants.&#8221;\r\n<P><\/P>\r\nThe <a href=https:\/\/lgc.unm.edu\/support-fund>council&#8217;s own programs<\/a> do not identify Indians, or mixed Indians for that matter, as beneficiaries. In fact, the <a href=https:\/\/lgc.unm.edu\/support-fund>guidelines for the &#8220;Spanish &#038; Mexican Community Land Grants-Mercedes Support Fund&#8221;<\/a> make clear that only land grant heirs &#8212; and no other entities &#8212; can receive taxpayer money. \r\n<p><\/p>\r\nUnder New Mexico law, the <em>mercedes<\/em> are treated as political subdivisions of the state. In contrast, tribal nations exercise inherent sovereignty, independent of local, state or federal law.\r\n<P><\/P>\r\nDespite the subtle shift in language from the New Mexico Land Grant Council, some individual land grant descendants have been asserting various forms of Indian identity for   longer periods of time,  even <a href=https:\/\/www.nytimes.com\/2018\/01\/28\/us\/indian-slaves-genizaros.html>resorting to DNA tests<\/a> to prove a <a href=https:\/\/manitos.net\/2019\/01\/29\/dna-at-the-community-level\/>genetic relationship with their claimed ancestors<\/a>. A common claim  in this category is that of   <em>gen\u00edzaro<\/em>, or a  belief in <a href=https:\/\/indianz.com\/News\/2018\/01\/29\/descendants-of-former-slaves-in-southwes.asp>descent from Indian people who were enslaved during Spanish rule<\/a>. Others equate  <em>gen\u00edzaro<\/em> with people who were   &#8220;detribalized&#8221; &#8212; or somehow lost their supposed &#8220;tribal&#8221; status.\r\n<p><\/p>\r\nIn the case of the <a The screenshots represent portions of the   performance that was recorded in  Abiqui\u00fa, New Mexico, for the   &#8220;<a href=https:\/\/nmai.brand.live\/c\/the-other-slavery>The Other Slavery<\/a>&#8221; symposium.<\/figcaption><HR>\r\n<P><\/P>\r\nNew Mexico is home to <a href=https:\/\/www.apcg.org\/>19 Pueblo tribes<\/a>, the <a href=https:\/\/www.navajo-nsn.gov\/\/>Navajo Nation<\/a>, the <a href=https:\/\/janofficial.com\/>Jicarilla Apache Nation<\/a> and the <a href=https:\/\/mescaleroapachetribe.com\/>Mescalero Apache Tribe<\/a>. The <a href=https:\/\/fortsillapache-nsn.gov\/>Fort Sill Apache Tribe<\/a>, whose ancestors were <a href=https:\/\/en.wikipedia.org\/wiki\/Fort_Sill_Apache_Tribe>taken as prisoners of war by the United States<\/a> during the late 1800s, have since made a return to their ancestral lands after being removed to Oklahoma.\r\n<P><\/P>\r\nNo Pueblo, Navajo or Apache leaders testified about H.R.5493 at the hearing on Tuesday, however. And no tribal leaders were on the witness list when an earlier version of the consultation bill was <a href=https:\/\/naturalresources.house.gov\/hearings\/legislative-hearing-on-us-forest-service-and-bureau-of-land-management-bills>taken up by the same subcommittee<\/a> during the prior session of Congress.\r\n<P><\/P>\r\nThe <a href=https:\/\/www.indianz.com\/covid19\/2020\/06\/15\/house-committee-on-natural-resources-116th-congress-2\/>earlier version of the consultation bill<\/a> easily passed the <a href=https:\/\/www.house.gov\/>U.S. House of Representatives<\/a> during the 116th Congress, after the chamber shifted to Democratic control for the first time  in over a decade. The bill never made it through the <a href=https:\/\/www.senate.gov\/>U.S. Senate<\/a>, which was then under Republican rule. The latter chamber is now led by Democrats.\r\n<P><\/P>\r\nIn addition to    H.R.5493, another measure of interest was on the agenda  on Tuesday. Chairman\r\nAnthony Roberts of the <a href=https:\/\/www.yochadehe.org\/>Yocha Dehe Wintun Nation<\/a>  testified in support of the measure.\r\n<p><\/p>\r\n&#8220;This co-stewardship provision is extremely important to us,&#8221; Roberts  told lawmakers. &#8220;First of all, it requires the responsible federal agencies to complete a management plan for the monument. Although the  monument was originally designated back in 2015, there is no monument management plan\r\ncurrently in place.&#8221;\r\n<P><\/p>\r\n&#8220;Second, H.R. 6366 ensures that tribal knowledge, perspective, and practices will be part of the monument&#8217;s management going forward. That makes sense,&#8221; he continued. &#8220;After all, the area&#8217;s unique cultural resources and history were among the original reasons for its protection.&#8221;\r\n<P><\/P>\r\n&#8220;Third, the co-stewardship provisions of H.R.6366 represent an important opportunity for innovation while also remaining firmly grounded in federal law and policy,&#8221; Roberts concluded, underscoring the manner in which the bill upholds the trust obligations of the U.S.\r\n<p><\/p>\r\nhttps:\/\/www.twitter.com\/CNPS\/status\/1497666571266711554\r\n<p><\/p>\r\nLambrecht, the official from the BLM, said the Biden administration supports the bill, which adds about 3,900 acres of land already under federal control to Berryessa Snow.
