Giordano Jackson &#8211; December 8, 2021<\/a>\r\n<\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">Court: Navajo man guilty of assault can\u2019t be convicted of kidnapping, too<\/div>\r\n<div class=\"date\">Monday, February 28, 2022<\/div>\r\n<div class=\"byline\">By Emily Sacia<\/div>\r\n<DIV class=source>Cronkite News<\/DIV>\r\n<DIV class=source-website><A \r\nhref=\"https:\/\/cronkitenews.azpbs.org\/\">cronkitenews.azpbs.org<\/A><\/DIV>\r\n<p><\/p>\r\nWASHINGTON &#8211; A federal appeals court ruled that a Navajo man who held his girlfriend while he assaulted her cannot also be convicted of kidnapping, saying such an expansion of kidnapping would lead to a &#8220;steroidal version&#8221; of assault laws.<P><\/P>\r\nThe ruling by a 9th U.S. Circuit Court of Appeals panel let stand the assault conviction against Giordano Jackson but reversed his kidnapping conviction in the 2017 beating of his girlfriend, Alvina Nez.<P><\/P>\r\nJackson was later convicted for Nez&#8217;s murder in a separate assault and is serving a life sentence on that charge. The court February 3  upheld that conviction.<P><\/P>\r\n&#8220;This case requires us to define the limits of kidnapping,&#8221; said <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2022\/02\/28\/19-10070.pdf\">the opinion<\/a> written by Circuit Judge John B. Owens. An attorney for Jackson did not immediately respond to requests for comment.<P><\/P>\r\nThe case began in July 2017 at Nez&#8217;s father&#8217;s home on the Navajo Reservation. Nez&#8217;s son and his cousin heard what they first thought was laughter, but when they went outside they saw Jackson beating Nez and trying to yank her from a car.<P><\/P>\r\nThe boys ran inside to wake their grandparents, and Nez&#8217;s father came out to find Alvina bloodied and beaten on the ground by the car, stripped to her underwear. He ordered Jackson off the property.<P><\/P>\r\nThe court said Alvina had &#8220;scratches and bruises on her arms, legs and face, a black eye, blood dripping from her nose and a bald spot on her head&#8221; caused by Jackson trying to pull her by her hair into a nearby hogan.<P><\/P>\r\n<div class=\"h5-responsive sub\">9th Circuit Court of Appeals Decision: <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2022\/02\/28\/19-10070.pdf\">USA v Giordano Jackson<\/a><\/div>\r\n<div class=row><div class=col-md-10>\r\n<div class=\"wp-block-pdfemb-pdf-embedder-viewer\"><a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2022\/02\/28\/19-10070.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-toolbar=\"both\" data-toolbar-fixed=\"on\">19-10070<\/a><\/div>\r\n<\/div><\/div>\r\n<P><\/P>\r\nJackson was charged with assault resulting in serious bodily injury and kidnapping, and convicted after a trial in which the evidence presented by Nez&#8217;s father and the boys was &#8220;largely uncontroverted.&#8221;<P><\/P>\r\nJackson&#8217;s attorney conceded that the evidence was sufficient for an assault charge, but not for kidnapping, saying that &#8220;whatever seizure occurred, it certainly didn&#8217;t occur beyond whatever beating there was.&#8221;<P><\/P>\r\nBut the trial judge agreed with the prosecutor that all that is needed for a kidnapping charge is &#8220;a restraint on someone\u2019s freedom of movement, preventing somebody from leaving if they want to.&#8221;<P><\/P>\r\nOn appeal, the 9th Circuit said courts have to be careful to limit the use of kidnapping to &#8220;appropriate circumstances.&#8221; Otherwise, prosecutors would have &#8220;unfettered discretion to charge the same conduct, such as impeding certain individuals, as a mere misdemeanor or a life imprisonment felony.&#8221;<P><\/P>\r\nOwens noted that prosecutors <a href=\"https:\/\/www.ca9.uscourts.gov\/media\/video\/?20211208\/19-10070\/\">conceded at argument<\/a> in Jackson&#8217;s appeal that the theory of kidnapping under which Jackson was convicted could allow &#8220;a garden-variety, three-minute robbery could be a kidnapping.&#8221;<P><\/P>\r\n<div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><p><\/p>\r\nThe appeals court focused on the fact that the assault lasted just six or seven minutes and that the actions did not reflect &#8220;the essence of kidnapping.&#8221;<P><\/P>\r\n&#8220;The primary conduct here was an assault causing serious bodily injury, which inherently requires the defendant to keep the victim in close enough proximity to inflict the injuries,&#8221; Owens wrote.<P><\/P>\r\n&#8220;The conduct here did not go beyond that,&#8221; he wrote. &#8220;No additional holding occurred; the assault involved no asportation, no external restraints, no planned detention, and no restrictions on movement beyond the beating itself.&#8221;<P><\/P>\r\nOwens wrote that jurors &#8220;properly convicted&#8221; Jackson of assault, but that the facts could not support a kidnapping conviction.<P><\/P>\r\n <a href=\"https:\/\/indianz.com\/News\/2022\/02\/28\/cronkite-news-appeals-court-rules-in-domestic-violence-case-on-navajo-nation\/teestochapterhouse\/\" rel=\"attachment wp-att-21578\"><img loading=\"lazy\" decoding=\"async\" width=\"2560\" height=\"1707\" data-attachment-id=\"21578\" data-permalink=\"https:\/\/indianz.com\/News\/2022\/02\/28\/cronkite-news-appeals-court-rules-in-domestic-violence-case-on-navajo-nation\/teestochapterhouse\/\" data-orig-file=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2022\/02\/28\/teestochapterhouse-scaled.jpg\" data-orig-size=\"2560,1707\" data-comments-opened=\"0\" data-image-title=\"Teesto Chapter\" data-image-description=\"&lt;p&gt;Teesto Chapter on the Navajo Nation&lt;\/p&gt;\n\" data-image-caption=\"&lt;p&gt;The Teesto Chapter is located on the Arizona portion of the Navajo Nation.
