Accordingly, we seek to work closely with our tribal partners to safeguard the rights of both tribes and individuals.<\/em>\r\n<\/div>\r\n<p><\/p>\r\nThe BIA\u2019s statement marks the second time the Biden administration has professed a commitment to protecting Indigenous individuals\u2019 human rights from violation by Tribal governments, and a break from modern administrations that focused almost exclusively on supporting Tribal self-determination rights. \r\n<p><\/p>\r\n<div class=\" content_cards_card content_cards_domain_twitter-com\">\n\t\t\t<div class=\"content_cards_image\">\n\t\t\t\t<a class=\"content_cards_image_link\" href=\"https:\/\/twitter.com\/NDNlawyer\/status\/1485003984028852229\">\n\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/indianz.com\/News\/wp-content\/plugins\/content-cards\/skins\/default\/content-cards-placeholder.png\" alt=\"X \/ ?\">\t\t\t\t<\/a>\n\t\t<\/div>\n\t\n\t<div class=\"content_cards_title\">\n\t\t<a class=\"content_cards_title_link\" href=\"https:\/\/twitter.com\/NDNlawyer\/status\/1485003984028852229\">\n\t\t\tX \/ ?\t\t<\/a>\n\t<\/div>\n\t<div class=\"content_cards_description\">\n\t\t<a class=\"content_cards_description_link\" href=\"https:\/\/twitter.com\/NDNlawyer\/status\/1485003984028852229\">\n\t\t\t\t\t<\/a>\n\t<\/div>\n\t<div class=\"content_cards_site_name\">\n\t\t<img decoding=\"async\" src=\"https:\/\/abs.twimg.com\/favicons\/twitter.3.ico\" alt=\"twitter.com\" class=\"content_cards_favicon\"\/>\t\ttwitter.com\t<\/div>\n<\/div>\r\n<p><\/p>\r\nUSA Today also highlights <a href=https:\/\/www.hud.gov\/press\/speeches_remarks_statements\/Statement_20211022>HUD Secretary Marcia Fudge&#8217;s October statement encouraging four Oklahoma tribes to accept descendants of Freedmen who once had been enslaved by the tribes<\/a>. Secretary Fudge consulted with Interior before making that statement.\r\n<p><\/p>\r\nNeither statement would have been issued without the guidance and support of Interior Secretary Deb Haaland or Assistant Secretary\u2014Indian Affairs Bryan Newland.  Indigenous representation does matter.\r\n<p><\/p>\r\nBoth the BIA and HUD statements represent historic commitments by the United States to protect Indigenous individuals from domestic human rights abuse by Tribal governments. Both statements reflect the Trustee\u2019s common-law moral trust responsibility to Tribal citizens and descendants. Both statements recognize that in the context of Indigenous human rights, Tribal sovereignty and self-determination are not absolute.\r\n<p><\/p>\r\n<div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><p><\/p>\r\nAs explained by USA Today:\r\n<p><\/p>\r\n<div class=mx-4><EM>\r\nGalanda, a Seattle lawyer and member of the Round Valley Indian Tribes of California, said earlier Supreme Court decisions call for federal intervention under a &#8220;moral trust responsibility.&#8221; \r\n<p><\/p>\r\n&#8220;The tension lies between tribal self-determination and Indigenous human rights protection in the form of federal diplomatic intercession,&#8221; he said. &#8220;I think there have to be scenarios in which the Indigenous human rights violation is so atrocious and so threatening to an Indigenous community&#8217;s existence that the (U.S. government) must exercise its moral trust responsibility.&#8221; \r\n<\/em><\/div>\r\n<p><\/p>\r\nI wholeheartedly applaud the Biden administration, particularly Secretary Haaland and ASIA Newland, for boldly professing a commitment to safeguard Indigenous individuals\u2019 human rights.\r\n<p><\/p><HR><EM>\r\nGabe Galanda is an Indigenous rights attorney and the managing lawyer at <a href=https:\/\/www.galandabroadman.com\/>Galanda Broadman<\/a> in Seattle.
