What follows is the text  of   press release from the <a href=https:\/\/www.hhs.gov\/>Department of Health and Human Services<\/a>. <\/em>\r\n<P><\/P>\r\nThe <a href=https:\/\/www.ihs.gov\/>Indian Health Service<\/a>  is announcing the <a href=https:\/\/www.federalregister.gov\/documents\/2022\/01\/13\/2021-28156\/acquisition-regulations-buy-indian-act-procedures-for-contracting>final rule on the Buy Indian Act<\/a> to strengthen its requirements to set aside contracts for Indian-owned and controlled businesses.\r\n<P><\/P>\r\n\u201cSupporting the growth of Native-owned and controlled businesses serving their communities is critical to supporting families facing the economic impact of the COVID-19 pandemic,\u201d said <a href=https:\/\/twitter.com\/SecBecerra>Health and Human Services Secretary Xavier Becerra<\/a>. \u201cThis e\ufb00ort is just one example of our commitment to tribal communities in support of the President&#8217;s Build Back Better framework to deliver meaningful outcomes for American Indians and Alaska Natives.\u201d\r\n<P><\/P>\r\n\u201cWith this final rule, we are clarifying the preference for Indian-owned businesses and removing barriers by alleviating unnecessary regulatory burdens,\u201d said IHS Acting Deputy Director Elizabeth Fowler. \u201cWe are committed to improving economic conditions and providing more opportunities for Native-owned businesses.\u201d\r\n<P><\/P>\r\n<div class=\" content_cards_card content_cards_domain_twitter-com\">\n\t\t\t<div class=\"content_cards_image\">\n\t\t\t\t<a class=\"content_cards_image_link\" href=\"https:\/\/twitter.com\/IHSgov\/status\/1481703849899536384\">\n\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2026\/06\/19\/fjaro03xwaekegb.jpg\" alt=\"Indian Health Service (@IHSgov) on X\">\t\t\t\t<\/a>\n\t\t<\/div>\n\t\n\t<div class=\"content_cards_title\">\n\t\t<a class=\"content_cards_title_link\" href=\"https:\/\/twitter.com\/IHSgov\/status\/1481703849899536384\">\n\t\t\tIndian Health Service (@IHSgov) on X\t\t<\/a>\n\t<\/div>\n\t<div class=\"content_cards_description\">\n\t\t<a class=\"content_cards_description_link\" href=\"https:\/\/twitter.com\/IHSgov\/status\/1481703849899536384\">\n\t\t\t<p>The Indian Health Service is announcing the final rule on the Buy Indian Act to strengthen requirements to set aside contracts for Indian-owned and controlled businesses. The rule supports the Indian Community Economic Enhancement Act of 2020, which requires the Indian Health Service and the Department of Interior Bureau of Indian Affairs to harmonize Buy Indian Act procurement procedures.  The Buy Indian Act is specifically applicable to IHS and the Bureau of Indian Affairs.\r\n<P><\/P>\r\nThe <a href=https:\/\/www.federalregister.gov\/documents\/2022\/01\/13\/2021-28156\/acquisition-regulations-buy-indian-act-procedures-for-contracting>final rule<\/a> will:\r\n<p><\/p>\r\n<ul>\r\n<li> alleviate unnecessary regulatory burden on Indian Economic Enterprises;\r\n\r\n<li> expand application of the Buy Indian Act to all construction including the planning, design and construction of health care facilities, personnel quarters, and water supply and waste disposal facilities;\r\n\r\n<li> better adhere to the language of the Buy Indian Act;\r\n\r\n<li> strengthen oversight of the Buy Indian Act to reduce the potential for fraud and abuse;\r\n\r\n<li> and clarify the preference for Indian Economic Enterprises;\r\n<\/ul>\r\n<P><\/P>\r\nThe IHS held several virtual tribal consultation sessions and received comments after posting the Notice of Proposed Rulemaking in the Federal Register in November 2020.
