But the prior Republican administration <a href=https:\/\/indianz.com\/News\/2019\/09\/24\/does-the-white-house-support-vawa-trump.asp>famously refused to support the effort<\/a> despite facing pressure to do so.\r\n<p><\/p>\r\nThe landscape has changed dramatically with Democratic President Joe Biden in office. Just last month, he signed an <a href=https:\/\/indianz.com\/News\/2021\/11\/15\/president-biden-signs-executive-order-addressing-violence-against-native-people\/>executive order to address high rates of violence in Indian Country<\/a>, promising to help get VAWA across the finish line so tribes can arrest, prosecute and punish people who engage in crimes like sexual assault, human trafficking and child abuse. \r\n<P><\/P>\r\n\u201cI&#8217;m directing federal officials to work with tribal nations on a strategy to improve public safety and advance justice,\u201d Biden said during the <a href=https:\/\/soundcloud.com\/indianz\/president-joe-biden-1?in=indianz\/sets\/white-house-tribal-nations-summit-day-one-november-15-2021>White House Tribal Nations Summit on November 15<\/a>. \u201cThis builds on the work we did together in reauthorizing the Violence Against Women Act in 2013, when we granted authority to try to exercise jurisdiction over non-Indian offenders who commit violence on tribal lands.\u201d\r\n<P><\/P>\r\n\u201cWe\u2019re going to reauthorize that again,\u201d Biden asserted of VAWA. \u201cWe\u2019re going to expand the jurisdiction to include other offenses like sex trafficking, sexual assault, and child abuse.\u201d\r\n <P><\/P>\r\n<div class=\"embed-responsive embed-responsive-16by9\">\r\n<span class=\"embed-youtube\" style=\"text-align:center; display: block;\"><iframe loading=\"lazy\" class=\"youtube-player\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/rtyDtFZO2fo?version=3&#038;rel=1&#038;showsearch=0&#038;showinfo=1&#038;iv_load_policy=1&#038;fs=1&#038;hl=en-US&#038;autohide=2&#038;wmode=transparent&#038;listType=playlist&#038;list=PLUZ4SOc8isRe7HdJ_r9SqM3cucXf0J3BW\" allowfullscreen=\"true\" style=\"border:0;\" sandbox=\"allow-scripts allow-same-origin allow-popups allow-presentation allow-popups-to-escape-sandbox\"><\/iframe><\/span>\r\n<\/div>\r\n<figcaption class=\"figure-caption\">Indianz.Com Video: <a href=https:\/\/youtu.be\/rtyDtFZO2fo?list=PLUZ4SOc8isRe7HdJ_r9SqM3cucXf0J3BW>President Joe Biden &#8211; White House Tribal Nations Summit &#8211; November 15, 2021<\/a>\r\n<\/figcaption>\r\n<p><\/p>\r\nIn 2013, Congress recognized <a href=https:\/\/indianz.com\/News\/2013\/03\/08\/obama-cites-inherent-right-of.asp>inherent tribal sovereignty over non-Indians<\/a> for the first time since a disastrous U.S. Supreme Court decision known as <a href=https:\/\/en.wikipedia.org\/wiki\/Oliphant_v._Suquamish_Indian_Tribe><em>Oliphant v. Suquamish Indian Tribe<\/em><\/a>. But the law is limited to a <a href=https:\/\/indianz.com\/News\/2018\/03\/20\/tribes-cite-progress-since-passage-of-vi.asp>certain set of domestic violence crimes<\/a>, and only applies to offenders with <a href=https:\/\/www.justice.gov\/sites\/default\/files\/tribal\/legacy\/2014\/02\/06\/vawa-2013-tribal-jurisdiction-overnon-indian-perpetrators-domesticviolence.pdf>ties to tribal communities<\/a>. \r\n<P><\/P>\r\nTo close up gaps in public safety, tribes are seeking to update VAWA to cover violence committed by strangers and crimes that occur when children are present. They also want to address assaults on tribal law enforcement. \r\n<p><\/p>\r\n\u201cThe biggest thing that I believe tribal nations need  and want for justice and public safety in Indian Country is empowerment,\u201d President Whitney Gravelle of the <a href=https:\/\/www.baymills.org>Bay Mills Indian Community<\/a> said during a <a href=https:\/\/youtu.be\/EzBxp4J00xE?list=PLUZ4SOc8isRe7HdJ_r9SqM3cucXf0J3BW>policy panel at the Tribal Nations Summit<\/a>.   \u201cWe must empower our tribal nations with the ability and resources to allow them to adequately prosecute, punish  and investigate the crimes committed against our people on our land.\u201d\r\n<P><\/P>\r\nThe crisis of missing and murdered Native people, especially women and girls, is high on the agenda as well as VAWA comes up for reauthorization. During the panel discussion, <a href=https:\/\/www.facebook.com\/JANET-DAVIS-PLPT-Chairwoman-102142275209013\/>Chairwoman Janet Davis<\/a> of the <a href=\"https:\/\/plpt.nsn.us\">Pyramid Lake Paiute Tribe<\/a> shared how tragedy hit close to home with the murder of her niece, <a href=https:\/\/twitter.com\/indianz\/status\/1460341911273803782>Amanda Davis<\/a>, and the death of her niece&#8217;s unborn child. The December 2020 crime, which is still being <a href=https:\/\/twitter.com\/indianz\/status\/1460343577939218441>prosecuted in the federal system<\/a>,  took place in front of Amanda&#8217;s young children on the reservation in Nevada.\r\n<P><\/p>\r\n\u201cHer mother, tribal  relatives and clergy weren&#8217;t  allowed in the home or near the body for over 20 hours,\u201d Davis recalled. \u201cWould this have been allowed 45 miles away in Reno, Nevada? After joining the Biden administration in March, she has promised to help tribes with public safety and justice needs.\r\n<P><\/P>\r\n\u201cIn my first month, as Secretary of the Interior, I launched our missing and murdered unit to help put the full weight of the federal government into investigating these cases and marshal law enforcement resources across federal agencies and throughout Indian Country,\u201d  Haaland, who is a citizen of the Pueblo of Laguna, said during the Tribal Nations Summit.\r\n<p><\/p>\r\nA hearing in the <a href=https:\/\/indian.senate.gov\/>Senate Committee on Indian Affairs<\/a> on Wednesday afternoon is part of the renewed attention on VAWA.  Haaland, who is the first Native person in a presidential cabinet, will be represented by Principal Deputy Assistant Secretary for  Indian Affairs Wizipan Little Elk Garriott, a  citizen of the Rosebud Sioux Tribe.\r\n<p><\/p>\r\n The <a href=https:\/\/www.justice.gov\/>Department of Justice<\/a>, whose leader, Attorney General Merrick Garland,  <a href=https:\/\/www.youtube.com\/watch?v=cOCqFE7Zq0Q&#038;list=PLUZ4SOc8isRe7HdJ_r9SqM3cucXf0J3BW&#038;index=4>addressed the White House gathering<\/a>, is also sending a representative with Allison Randall, who serves as the Principal Deputy Director of the <a href=https:\/\/www.justice.gov\/ovw>Office on Violence Against Women<\/a>. In her written testimony, she said women from the <a href=https:\/\/ebci.com\/>Eastern Band of Cherokee Indians<\/a>    \u201csaved my life\u201d at a domestic violence shelter in North Carolina.\r\n<p><\/p>\r\n\u201cThey embraced me, taught me, and encouraged me to give back to other survivors, sparking my lifelong dedication to\r\nreducing domestic and sexual violence,\u201d  <a href=https:\/\/indianz.com\/News\/wp-content\/uploads\/2021\/12\/08\/allisonrandall120821.pdf>Randall&#8217;s statement<\/a> reads. \u201cIt is thanks to those Cherokee women that I sit before you today.\u201d\r\n<p><\/p>\r\n<div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div>\r\n<p><\/p>\r\nThe <a href=https:\/\/www.house.gov\/>U.S. House of Representatives<\/a> passed <a href=https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/1620>H.R.1620<\/a>, the Violence Against Women Act Reauthorization Act, back in March. The legislation expands recognition of tribal jurisdiction over non-Indians  and includes provision to address the crisis of missing and murdered Native people.\r\n<p><\/p>\r\nGetting the bill passed in the <a href=https:\/\/www.senate.gov\/>U.S. Senate<\/a>, however, hasn&#8217;t been easy. Tribal advocacy organizations  like the <a href=https:\/\/niwrc.quorum.us\/campaign\/35357\/>National Indigenous Women&#8217;s Resource Center<\/a> (NIWRC) and the  <a href=https:\/\/twitter.com\/NCAI1944\/status\/1450824232846479365>National Congress of American Indians<\/a> (NCAI)  ramped up lobbying efforts during  <a href=https:\/\/indianz.com\/News\/2021\/09\/30\/october-is-domestic-violence-awareness-month\/>Domestic  Violence Awareness Month<\/a> in October in hopes of finally getting VAWA reauthorized. \r\n<P><\/P>\r\n\u201cViolence against Indigenous peoples began with European contact and has continued to this day, adding up to more than 500 years of abuse,\u201d the <a href=https:\/\/www.strongheartshelpline.org\/>StrongHearts Native Helpline<\/a>, a project of the NIWRC, said in <a href=https:\/\/indianz.com\/News\/2020\/10\/01\/stronghearts-native-helpline-october-dvam\/>October<\/a>.  \u201cDomestic violence, which continues as a tool of colonization, represents a lack of respect for Native peoples.\u201d \r\n<p><\/p>\r\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">\ud83d\udea8 ACTION ALERT\ud83d\udea8Native women can\u2019t wait! But during the Donald Trump era, Republicans  in large droves  abandoned their support for reauthorization, <a href=https:\/\/indianz.com\/News\/2019\/03\/18\/an-abomination-republicans-try-to-strip.asp>objecting to the   pro-tribal provisions<\/a> and other provisions they say are outside of the scope of the original law.\r\n<P><\/P>\r\nThe doubts persist even though Trump is out of office. When <a href=https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/1620\/actions>H.R.1620 passed the House<\/a> on March 17, only 29 Republicans voted for it.  Just  two Republicans are <a href=https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/1620\/cosponsors?r=4&#038;s=1>co-sponsoring the bill<\/a>.\r\n<p><\/p>\r\nThe <a href=https:\/\/clerk.house.gov\/Votes\/202186>roll call of YEAs<\/a> included three of the four tribal citizens who serve in the chamber: <a href=https:\/\/davids.house.gov>Rep. Sharice Davids<\/a> (D-Kansas), a citizen of the Ho-Chunk Nation; <a href=https:\/\/cole.house.gov>Rep. Tom Cole<\/a> (R-Oklahoma), a citizen of the Chickasaw Nation; and <a href=https:\/\/mullin.house.gov>Rep. Markwayne Mullin<\/a> (R-Oklahoma), a citizen of the Cherokee Nation.\r\n<p><\/p>\r\nOn the other hand, <a href=https:\/\/herrell.house.gov>Rep. Yvette Herrell<\/a> (R-New Mexico), a newcomer to Congress who is a citizen of the Cherokee Nation, joined almost all of her fellow Republicans in voting against the pro-tribal version of VAWA.
