Salazar"},"content":{"rendered":"The <a href=https:\/\/www.house.gov\/>U.S. House of Representatives<\/a> considers <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/4352\">H.R.4352<\/a>, a legislative fix to the <a href=https:\/\/www.supremecourt.gov\/>U.S. Supreme Court<\/a> decision in <a href=https:\/\/en.wikipedia.org\/wiki\/Carcieri_v._Salazar><EM>Carcieri v. Salazar<\/em><\/a>, on December 1, 2021.\r\n<p><\/p>\r\nThe bill ensures that all federally recognized tribes, regardless of the date of federal recognition, can restore their homelands through the <a href=https:\/\/www.bia.gov\/bia\/ots\/fee-to-trust>land-into-trust process<\/a>. The 2009 ruling in <EM>Carcieri<\/em> otherwise requires tribes to show they were \u201cunder federal jurisdiction\u201d as of 1934, creating uncertainty and injecting hurdles into the process.\r\n<p><\/p>\r\n\u201cPlacing land into trust is vital for tribal sovereignty and self-determination and we must remember\r\nthat most of the land sought to be placed in trust is actually historic\r\nland, aboriginal land of the tribes themselves,\u201d said <a href=\"https:\/\/fernandez.house.gov\">Rep.
