Official <a href=https:\/\/www.flickr.com\/photos\/whitehouse\/51224604501\/>White House Photo by Adam Schultz<\/a><\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">Trail of Tears and tribal treaty cited in threats against President Biden<\/div>\r\n<div class=\"date\">Tuesday, June 22, 2021<\/div>\r\n<div class=\"byline\">By Acee Agoyo<\/div>\r\n<div class=\"source\">Indianz.Com<\/div>\r\n<p><\/p>\r\nAn Oklahoma man has been arrested and charged  after citing the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Trail_of_Tears\">Trail of Tears<\/a> and the <a href=\"https:\/\/www.blackpast.org\/african-american-history\/u-s-treaty-creek-nation-1866\/\">Muscogee Nation&#8217;s Treaty of 1866<\/a> when making violent threats against President Joe Biden.\r\n<p><\/p>\r\nJohn Jacobs Ahrens, 58, was <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2021\/06\/22\/14712772744.pdf\">charged in federal court<\/a> on Monday with one count of making a <a href=\"https:\/\/en.wikipedia.org\/wiki\/Threatening_the_president_of_the_United_States\">threat against the president of the United States<\/a>. According to the <a href=\"https:\/\/www.justice.gov\/usao-ndok\/pr\/tulsa-man-charged-sending-emails-threatening-president-biden\">U.S. Attorney&#8217;s Office for the Northern District of Oklahoma<\/a>, he sent multiple messages about Biden and the U.S. Congress to the <a href=\"https:\/\/www.newson6.com\">KOTV news station<\/a>.\r\n<P><\/p>\r\nOn May 10, for example, Ahrens threatened   members of the legislative branch. According to the complaint, he wrote: \u201cThey have less than 48 hours to hand over my money or their children will start dying all over the country. I\u2019m going to kill their children using the same law as the Government used to force our families on to the Trail of Tears.\u201d\r\n<p><\/p>\r\n<div class=\"h5-responsive sub\">PDF: <a href=https:\/\/indianz.com\/News\/wp-content\/uploads\/2021\/06\/22\/14712772744.pdf>United States of America v. On June 10, he wrote: \u201cI just sent an ultimatum to the White House.\u201d\r\n<p><\/p>\r\n\u201cAmerica is going to get to see a sitting President get his head blown off right in front of them,\u201d he added, according to the complaint.\r\n<p><\/p>\r\nA week after that, Ahrens brought up the Treaty of 1866. He made an unspecified demand for money.\r\n<p><\/p>\r\n\u201cYou have until Monday morning 8:00 am sharp to hand a check over to the State of Oklahoma, the Muscogee Nation and my family in accordance with a signed agreement as set forth in the Treaty of 1866,\u201d Ahrens wrote on June 17, according to federal authorities.\r\n<P><\/P><div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><p><\/p>\r\nThe <a href=\"https:\/\/www.muscogeenation.com\">Muscogee Nation<\/a>, the <a href=\"https:\/\/www.cherokee.org\">Cherokee Nation<\/a>, the <a href=\"https:\/\/chickasaw.net\">Chickasaw Nation<\/a>, the <a href=\"https:\/\/www.choctawnation.com\">Choctaw Nation<\/a> and the <a href=\"https:\/\/www.sno-nsn.gov\">Seminole Nation<\/a> were forced to leave their homelands in the southeast by the U.S. government during the 1830, in a series of events known as the Trail of Tears. They were <a href=\"https:\/\/en.wikipedia.org\/wiki\/Indian_removal\">removed to Indian Territory<\/a>, known today as the state of Oklahoma.\r\n<p><\/P>\r\nBiden visited Oklahoma on June 1. He traveled to Tulsa to <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/06\/02\/remarks-by-president-biden-commemorating-the-100th-anniversary-of-the-tulsa-race-massacre\/\">commemorate the 100th anniversary<\/a> of the  May 31, 1921, <a href=\"https:\/\/indianz.com\/News\/2021\/06\/07\/chuck-hoskin-cherokee-nation-honors-victims-of-massacre-at-black-wall-street\/\">massacre of Black residents of the Greenwood District<\/a>   in the city, which is located within the boundaries of the Muscogee Nation.\r\n<p><\/p>\r\n\u201cEnough people who believed that America does not belong to everyone and not everyone is created equal \u2014 Native Americans, Asian Americans, Hispanic Americans, Black Americans,\u201d Biden said at the <a href=\"https:\/\/www.greenwoodculturalcenter.org\">Greenwood Cultural Center<\/a>.  \u201cA belief enforced by law, by badge, by hood and by noose.\u201d\r\n<p><\/p>\r\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">We can\u2019t just choose to learn what we want to know \u2014 and not what we should know.<br><br>We memorialize what happened in Tulsa 100 years ago so it can\u2019t be erased.<\/p>&mdash; President Biden (@POTUS) <a href=\"https:\/\/twitter.com\/POTUS\/status\/1399876666101534720?ref_src=twsrc%5Etfw\">June 1, 2021<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\r\n<P><\/P>\r\nThe 1866 Treaty with the Creeks, like the treaties with the Cherokees, Chickasaws, Choctaws and Seminoles,  was <a href=\"https:\/\/www.okhistory.org\/publications\/enc\/entry.php?entry=RE001\">negotiated following the end of the Civil War<\/a>. It requires the Muscogee Nation to recognize  the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Creek_Freedmen\">Creek Freedmen<\/a>, who at the time were enslaved   within tribal territory, as full citizens.\r\n<p><\/p>\r\nDespite the <a href=http:\/\/www.1866creekfreedmen.com\/docpage\/info\/1866ty.pdf>provision in Article 2<\/a>, the Muscogee Nation does not recognize the Freedmen descendants  as citizens.    Only the Cherokee Nation   abides by  its treaty, an <a href=\"https:\/\/indianz.com\/News\/2021\/02\/24\/chuck-hoskin-the-cherokee-nation-must-honor-its-word\/\">obligation that was fulfilled<\/a> following <a href=\"https:\/\/indianz.com\/News\/2017\/09\/05\/cherokee-nation-accepts-court-ruling-and.asp\">decades<\/a> of <a href=\"https:\/\/www.indianz.com\/news\/archives\/000930.asp\">controversy<\/a> and <a href=\"https:\/\/indianz.com\/News\/2017\/08\/30\/freedmen-win-landmark-ruling-confirming.asp\">litigation<\/a>. \r\n<p><\/p> \r\nAnd while the  Seminole Nation  was   <a href=\"https:\/\/indianz.com\/News\/show.asp?ID=2002\/09\/24\/seminole\">prevented from disenrolling its Freedmen<\/a> in the early 2000s, the tribe continues to   restrict  their  participation in certain programs.\r\n<p><\/p>\r\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">\u201cThe Cherokee Nation\u2019s actions have brought this longstanding issue to a close and have importantly fulfilled their obligations to the Cherokee Freedmen,\u201d <a href=\"https:\/\/twitter.com\/SecDebHaaland?ref_src=twsrc%5Etfw\">@SecDebHaaland<\/a> said in approving <a href=\"https:\/\/twitter.com\/CherokeeNation?ref_src=twsrc%5Etfw\">@CherokeeNation<\/a> constitution to protect Freedmen citizenship rights. <a href=\"https:\/\/t.co\/NWB7p7K6hI\">https:\/\/t.co\/NWB7p7K6hI<\/a><\/p>&mdash; indianz.com (@indianz) <a href=\"https:\/\/twitter.com\/indianz\/status\/1392562510469943297?ref_src=twsrc%5Etfw\">May 12, 2021<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\r\n<p><\/p>\r\nShortly before Biden&#8217;s visit, the Choctaw Nation  announced an <a href=https:\/\/www.choctawnation.com\/chief-voice\/open-letter-chief-gary-batton>initiative to restore the  Choctaw Freedmen<\/a> to citizenship. The Chickasaw Nation, which never fully implemented the Freedmen provisions of the <a href=\"https:\/\/www.blackpast.org\/african-american-history\/u-s-treaty-choctaw-chickasaw-nations-1866\/\">Choctaw and Chickasaw treaty<\/a>, has not made any public statements  about the issue. \r\n<p><\/p>\r\nThe leaders of  the Muscogee, Cherokee, Chickasaw, Choctaw and Seminole tribes greeted Biden during his arrival in Tulsa  and took part in the commemoration of the Greenwood massacre earlier this month \r\n<a href=\"https:\/\/twitter.com\/SecDebHaaland\">Secretary Deb Haaland<\/a>, who leads the <a href=https:\/\/www.doi.gov\/>Department of the Interior<\/a>, has encouraged these tribes to   \u201c<a href=\"https:\/\/indianz.com\/News\/2021\/05\/12\/cherokee-nation-constitution-approved-with-protections-for-freedmen-citizens\/\">meet their moral and legal obligations to the Freedmen<\/a>.\u201d\r\n<p><\/p>\r\nA conviction of violating  <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/871\">18 U.S.C. \u00a7 871<\/a> is punishable by up to 5 years in prison and by a fine of up to $250,000.\r\n<P><\/p>\r\n\u201cMaking online threats to murder public officials and their families has consequences,\u201d said acting U.S. Attorney Clint Johnson. \u201cThe arrest
