Cooley<\/em> originated on the Crow Reservation in 2016.<\/div>\r\n<div class=\"date\">Friday, June 11, 2021<\/div>\r\n<div class=\"byline\">By Mara Silvers<\/div>\r\n<DIV class=\"source\">Montana Free Press<\/DIV>\r\n<DIV class=\"source-website\"><A \r\nhref=\"https:\/\/montanafreepress.org\/\">montanafreepress.org<\/A><\/DIV>\r\n<P><\/P>\r\nThe United States Supreme Court  last Tuesday reversed a lower court ruling limiting tribal law enforcement authority to stop and search non-Native residents. The high court\u2019s unanimous decision in <em>United States v. Cooley<\/em>, which originated on the Crow Reservation in southeast Montana, was heralded as a <a href=\"https:\/\/indianz.com\/News\/2021\/06\/01\/supreme-court-backs-tribal-sovereignty-in-law-enforcement-case\/\">win for tribal sovereignty and law enforcement authority<\/a>.\r\n<P><\/P>\r\nIn the June 1 <a href=https:\/\/indianz.com\/News\/wp-content\/uploads\/2021\/06\/01\/19-1414.pdf>opinion issued by Justice Stephen Breyer<\/a>, the court found that restricting tribal law enforcement officers from stopping, searching and temporarily detaining non-Native people could compromise officers\u2019 ability to protect the \u201chealth or welfare of the tribe.\u201d That language stems from a previous case, <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/450\/544\/\"><em>Montana v. United States<\/em><\/a>, in which the court ruled against the Crow Tribe\u2019s ability to regulate fishing and hunting by non-tribal members on land that is not owned by the tribe. That limitation on the tribe\u2019s enforcement authority, Breyer wrote, was issued with important exceptions, including a provision for responding to threats against a tribe\u2019s health or welfare.\r\n<P><\/P>\r\n\u201cTo deny a tribal police officer authority to search and detain for a reasonable time any person he or she believes may commit or has committed a crime would make it difficult for tribes to protect themselves against ongoing threats,\u201d Breyer wrote in the <em>Cooley<\/em> decision. \u201cSuch threats may be posed by, for instance, non-Indian drunk drivers, transporters of contraband, or other criminal offenders operating on roads within the boundaries of a tribal reservation.\u201d\r\n<p><\/p>\r\n<iframe loading=\"lazy\" width=\"100%\" height=\"400\" scrolling=\"no\" frameborder=\"no\" allow=\"autoplay\" src=\"https:\/\/w.soundcloud.com\/player\/?url=https%3A\/\/api.soundcloud.com\/tracks\/1014804295&#038;color=%23ff5500&#038;auto_play=false&#038;hide_related=false&#038;show_comments=true&#038;show_user=true&#038;show_reposts=false&#038;show_teaser=true&#038;visual=true\"><\/iframe>\r\n<figcaption class=\"figure-caption\">Indianz.Com Audio: <a href=https:\/\/indianz.com\/News\/2021\/03\/24\/u-s-supreme-court-u-s-v-cooley\/>U.S. Supreme Court &#8211;  United States v. A Crow Police Department officer found a man with a child in the backseat of his truck pulled over on the side of U.S. Highway 212, which runs through the Crow Nation.\r\n<p><\/p>\r\nThe officer, James Saylor, found that the man, Joshua Cooley, had \u201cwatery, bloodshot eyes\u201d and did not appear to be Native American. After a search of Cooley and the vehicle, Saylor found methamphetamine, a glass pipe and two semi-automatic rifles. \r\n<P><\/P>\r\nWhile he was later indicted on federal drug and gun offenses, Cooley\u2019s defense successfully argued to suppress the evidence Saylor had collected, citing the officer\u2019s lack of investigative authority over a non-Native person on a public road. The 9th Circuit Court of Appeals later upheld that decision, prompting the case to be appealed to the U.S. Supreme Court.\r\n<P><\/P>\r\nThe Crow Tribe did not immediately issue a statement in response to the court\u2019s   ruling. Chairman Frank White Clay could not be reached for comment.\r\n<P><\/P><div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><p><\/p>\r\nDuring <a href=\"https:\/\/montanafreepress.org\/2021\/03\/23\/supreme-court-hears-arguments-in-crow-case\/\">oral arguments in the case<\/a>, the Department of Justice attorney representing the petitioner argued that tribal law enforcement agents should be allowed to exercise authority over non-Native people, saying the 9th Circuit\u2019s ruling puts tribal members at risk.\r\n<P><\/P>\r\n\u201cThese areas are policed primarily often by tribal officers. And if they lack this authority, it\u2019s going to endanger everyone on the reservation,\u201d DOJ attorney Eric J. Feigin said in late March. \r\n<P><\/P>\r\nThe attorney representing the defendant, Eric H. Henkel, sought to convince the justices that tribes do not have authority over non-Native people and that Congress has \u201cplenary authority over Indian affairs.\u201d In his opinion, Breyer did not side with the defendant\u2019s argument, saying \u201cno treaty or statute has explicitly divested Indian tribes of the policing authority at issue,\u201d and that the case at hand fit within the exemptions outlined in the court\u2019s previous Montana ruling.\r\n<p><\/p>\r\n<HR><EM>Mara covers Montana\u2019s social welfare and criminal justice systems, including public health matters such as substance use disorders and mental health care.
