Kristi Noem<\/a> (R) eagerly hosted then-president Donald Trump at Mount Rushmore  for a fireworks display on the Fourth of July. The event drew <a href=\"https:\/\/indianz.com\/News\/2020\/06\/30\/harold-frazier-the-american-faces-carved.asp\">strong protests from the tribe<\/a> and its allies, who <a href=\"https:\/\/indianz.com\/News\/2020\/07\/27\/native-sun-news-today-tunkasila-sakpe-mt.asp\">pointed out that the land<\/a>  where it took place was <a href=\"https:\/\/indianz.com\/News\/2020\/07\/06\/jenni-monet-making-the-case-for-treaties.asp\">stolen from the Sioux Nation<\/a>.\r\n<P><\/P>\r\nBut if Noem were hoping for a return engagement  under a new presidential administration, she is running out of options. In a <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2021\/06\/03\/16513500541.pdf\">36-page decision on Wednesday<\/a>, a federal judge blocked her efforts to force yet another display of American colonization on the tribe.\r\n<P><\/P>\r\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"zxx\" dir=\"ltr\"><a href=\"https:\/\/t.co\/fu9RjFEwDF\">pic.twitter.com\/fu9RjFEwDF<\/a><\/p>&mdash; CRSTChairman (@CRSTChairman) <a href=\"https:\/\/twitter.com\/CRSTChairman\/status\/1400223813112053763?ref_src=twsrc%5Etfw\">June 2, 2021<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\r\n<P><\/P>\r\n\u201cOf course, we knew from the beginning that the Governor of the State of South Dakota did not make accurate statements to the court regarding participation of the Cheyenne River Sioux Sioux Tribe in the process of consultation,\u201d <a href=\"https:\/\/twitter.com\/CRSTChairman\/status\/1400223813112053763\">Chairman Harold Frazier said<\/a> in reaction to the ruling. \u201cThis is another example of the Governor overreaching her authority on federal land and treaty territory of the Great Sioux Nation.\u201d\r\n<P><\/p>\r\n\u201cThis decision will greatly enhance the ability of all the people to gather medicine and pray without the intrusion of explosions or lights,\u201d Frazier added. \u201cOur sacred land and sites will remain at peace while still being the sanctuary for the animals that can still call the Black Hills home or rely on the sanctuary for their journeys.&#8221;\r\n<p><\/p>\r\nDespite being rebuked by Judge Roberto A. Lange, Noem plans  to keep fighting both the tribe and the Joe Biden administration. Even though the event is slated to take place barely a month away on July 3, she plans to take the case to the <a href=\"https:\/\/www.ca8.uscourts.gov\">8th Circuit Court of Appeals<\/a>, prolonging the bitter battle further.\r\n<p><\/p>\r\n\u201cThe Biden administration cancelled South Dakota\u2019s Mount Rushmore Fireworks Celebration on completely arbitrary grounds,\u201d <a href=\"https:\/\/news.sd.gov\/newsitem.aspx?id=28137\">Noem asserted<\/a> on Wednesday.  &#8220;I am disappointed that the court gave cover to this unlawful action with today\u2019s decision.&#8221;\r\n<P><\/p>\r\n\u201cBut rest assured, this fight is not over,&#8221; the  Republican executive continued. &#8220;My legal team will appeal so that we can return the Fireworks Celebration to Mount Rushmore and celebrate our nation\u2019s birthday at America\u2019s Shrine to Democracy for next year and in the future.\u201d\r\n<p><\/p>\r\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">President <a href=\"https:\/\/twitter.com\/JoeBiden?ref_src=twsrc%5Etfw\">@JoeBiden<\/a> said that the 4th of July will be when we \u201cmark our independence from this virus.\u201d<br><br>But his administration doesn\u2019t want to hold such a celebration with fireworks at Mount Rushmore. Why? Their reasons are completely arbitrary &amp; unlawful.<a href=\"https:\/\/t.co\/ycTJ86dImp\">https:\/\/t.co\/ycTJ86dImp<\/a><\/p>&mdash; Governor Kristi Noem (@GovKristiNoem) <a href=\"https:\/\/twitter.com\/GovKristiNoem\/status\/1400466225822670848?ref_src=twsrc%5Etfw\">June 3, 2021<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\r\n<P><\/P>\r\nAs of Thursday afternoon, Noem had not yet filed an appeal in the 8th Circuit. In her lawsuit &#8212; which attracted the attention of <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2021\/06\/03\/16513495589.pdf\">Republican officials from 17 states<\/a> &#8212; she requested, and was <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2021\/06\/03\/16513492098.pdf\">granted<\/a>, expedited status in order to force  a decision before July 4.\r\n<P><\/p>\r\nShould Noem proceed with the case, Cheyenne River  and its advocates stand ready. But <a href=\"https:\/\/www.bigfirelaw.com\/nicole-e-ducheneaux\/\">attorney Nicole Ducheneaux<\/a>, who represents the tribe, characterized the entire affair as a charade, aimed at boosting the   governor&#8217;s appeal among Republicans, many of whom continue to believe in the false premise that Trump didn&#8217;t actually lose the 2020 election.\r\n<p><\/p>\r\n\u201cIn light of the high burden in this case, which the state did little to meet, Governor Noem\u2019s lawsuit does not appear to have been a serious effort to win an injunction,\u201d  said Ducheneaux, a Cheyenne River citizen.  \u201cInstead, it looks more like a piece of political theater aimed at exciting the Trump-Noem base.\u201d\r\n<p><\/p>\r\n \u201cWe are dismayed that Governor Noem has used the federal court to jeopardize our religious freedoms and our beautiful American landscape in service of her political ambitions,\u201d added  Ducheneaux, from  the Native-owned <a href=\"https:\/\/www.bigfirelaw.com\">Big Fire Law and Policy Group<\/a>. \u201cThe Lakota people have been fighting to protect our sacred Black Hills for nearly 200 years. The Cheyenne River Sioux Tribe is committed to finishing this fight in the Eighth Circuit and beyond if Governor Noem wants to take it there.\u201d\r\n<p><\/p><div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><p><\/p>\r\nThe current  dispute began when the Biden administration denied  Noem  a  permit to stage the  Independence Day  fireworks display at <a href=\"https:\/\/www.nps.gov\/moru\/index.htm\">Mount Rushmore National Memorial<\/a>. Though the site is currently controlled by the U.S. government, it lies within territory promised to the Sioux Nation by the <a href=\"https:\/\/www.ourdocuments.gov\/doc.php?flash=false&#038;doc=42\">1868 Treaty of Fort Laramie<\/a>.\r\n<p><\/p>\r\nThe history of the broken treaty was laid out in the decision on Wednesday.\r\n<p><\/p>\r\n\u201cThough that treaty preserved the Black Hills as part of the Great Sioux Indian Reservation, a gold rush beginning in the 1870s resulted in abrogation of the treaty and dispossession of the Black Hills from the Lakota, which ninety years later prompted the <a href=\"https:\/\/en.wikipedia.org\/wiki\/United_States_v._Sioux_Nation_of_Indians\">Supreme Court of the United States to observe<\/a>: \u2018A more ripe and rank case of dishonorable dealings will never, in all probability, be found in our history,\u2019 the judge wrote.\r\n<p><\/p>\r\nNoem&#8217;s   lawsuit notably names <a href=\"https:\/\/twitter.com\/SecDebHaaland\">Secretary of the Interior Deb Haaland<\/a> as the defendant.  In making history as the    <a href=\"https:\/\/indianz.com\/News\/2020\/12\/19\/i-am-honored-and-ready-to-serve-deb-haaland-and-the-joe-biden-administration\/\">first Native person named to a presidential cabinet<\/a>, she noted that a predecessor  in her role   \u201conce proclaimed it his goal to, quote, &#8216;civilize or exterminate&#8217; us.\u201d\r\n<P><\/p>\r\n \u201cI\u2019m a living testament to the failure of that horrific ideology,\u201d Haaland, a citizen of the Pueblo of Laguna, remarked before winning confirmation as the first Native person to lead the <a href=https:\/\/www.doi.gov\/>Department of the Interior<\/a>, where she oversees public sites like Mount Rushmore.\r\n<p><\/p>\r\n <IMG class=\"img-fluid wow fadeIn\" \r\nsrc=\"https:\/\/indianz.com\/News\/2018\/05\/04\/supremecourtsignpineridge.jpg\" \r\nitemprop=\"image\"><\/IMG> <FIGCAPTION class=figure-caption>A quote from the <A \r\nhref=\"https:\/\/www.leagle.com\/decision\/19751816518f2d129811565\">U.S. \r\nCourt of Claims decision in the Sioux Nation&#8217;s Black Hills land claim case<\/A> \r\nappears on a sign on the Pine Ridge Reservation in South Dakota. In court papers, government attorneys pointed out that the   Trump administration approved the 2020 permit over the objections of the Cheyenne River Sioux Tribe and other Indian nations.\r\n<P><\/p>\r\n\u201cYou can put all the lettuce and tomatoes and cheese on a rotten piece of meat, but that meat is still rotten,\u201d   a  <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2021\/06\/03\/16513492098.pdf\">tribal historic preservation officer  was quoted<\/a> by the <a href=\"https:\/\/www.justice.gov\/usao-sd\">U.S. Attorney&#8217;s Office in South Dakota<\/a> as saying. \u201cThat\u2019s what happens at some of these meetings. All this is, is dressing and we have to eat that rotten sandwich.\u201d\r\n<P><\/p>\r\n \u201cJust once it would be good to walk away from a meeting and knowing that the federal agency actually listened to us and takes our comments and concerns seriously and do that,\u201d the representative of the  <a href=\"http:\/\/www.spiritlakenation.com\">Spirit Lake Nation<\/a> said when Trump was still around.\r\n<P><\/p>\r\nDespite written records existing of the \u201cconsultation\u201d that took place last year,  Chairman Frazier said  Gov. At the height of the <a href=\/covid19\/>COVID-19 pandemic<\/a> in 2020, she <a href=\"https:\/\/www.indianz.com\/covid19\/2020\/05\/08\/governor-kristi-noem-r-south-dakota\/\">threatened to bring legal action<\/a> unless Cheyenne River  removed <a href=\"https:\/\/indianz.com\/News\/2020\/05\/21\/republican-governor-takes-coronavirus-ch.asp\">coronavirus checkpoints on the reservation.<\/a> \r\n<p><\/p>\r\nNoem never made good on her threat and the tribe kept operating the checkpoints to ensure that outsiders weren&#8217;t bringing the deadly  virus into the community. Tara Sweeney, a Trump appointee who  was the first Alaska Native person to serve as the <a href=\"https:\/\/indianz.com\/News\/2018\/08\/16\/tara-sweeney-quietly-takes-helm-at-burea.asp\">Assistant Secretary for Indian Affairs<\/a>, threatened to cut law enforcement funding to the tribe, according to <a href=\"https:\/\/www.indianz.com\/covid19\/2020\/06\/23\/cheyenne-river-sioux-tribe-v-donald-j-trump\/\">court documents<\/a>.\r\n<p><\/p>\r\n\u201cIn order for the tribe to retain its law enforcement contracts or to avoid emergency reassumption, there were some immediate steps  that needed to take place,\u201d <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2021\/06\/03\/tarasweneydoughoelscherharoldfrazier.pdf\">Sweeney told Frazier on a follow-up<\/a> call that included a second White House official.\r\n<P><\/p>\r\nAs the dispute dragged on into the fall,  Sweeney refused to let the matter go.
