S.D. Sioux tribe fights state subpoenas

TUESDAY, FEBRUARY 4, 2003

The state of South Dakota has filed a lawsuit in federal court against the Crow Creek Sioux Tribe, seeking enforcement of subpoenas on the reservation.

The state wants to force 11 reservation residents to testify before a grand jury about alleged voter fraud. One individual, Rebecca Red Earth-Villeda, is facing charges for allegedly forging ballot applications in last year's federal election.

The tribe said it won't allow the state to serve the subpoenas because the alleged crime occurred off the reservation.
