Ruling against death penalty overturned

WEDNESDAY, DECEMBER 11, 2002

A federal appeals court on Tuesday overturned a federal judge's ruling that struck down the death penalty.

A unanimous 2nd Circuit Court of Appeals said the constitutional rights of felons were not infringed by the federal death penalty law. The three-judge panel rejected assertions that the death penalty was "state-sponsored murder" because capital convictions have been overturned by DNA evidence.
