State ordered to return tribal property

The Winnebago Tribe of Nebraska has won another round in its battle against the state of Kansas.

A federal judge on Monday issued a preliminary injunction that requires the state to return two gas delivery trucks that belong to Ho-Chunk Inc., an economic development corporation of the tribe. The state is also barred from interfering with the tribe's business transactions with three Kansas tribes.

The dispute arose when the state seized the trucks and claimed the Winnebago Tribe owed gas delivery taxes. A ruling on the legality of the tax is pending.
