The Schaghticoke Tribal Nation and the town of Kent are waiting for the Bureau of Indian Affairs to issue a new decision on the Connecticut tribe's federal recognition.
The tribe won a final determination in favor of recognition in January 2004. But the town and the state appealed, leading the Interior Board of Appeals to require the BIA to issue a new decision.
The tribe wants the process to be fair and says local officials, residents and their lobbyists have violated a no-contact order with the Interior Department. A group called Town Action to Save Kent is resisting depositions.
Town leaders, meanwhile, say they are in a better position than they were last year. They say the IBIA ruling, which said the BIA relied too heavily on state recognition of the tribe, favors their position.
The BIA is expected to issue a new decision by October 12.
