Choctaw Nation faces delay in opening racetrack

Friday, September 16, 2005

The Choctaw Nation will have to retest its gaming machines before they can be used at the tribe's racetrack, the Oklahoma Horse Racing Commission ruled on Thursday.

Even though the machines have already been certified for use at tribal casinos, the commission said they must meet the commission's technical standards. The commission met for one hour behind closed doors before making the decision, The Oklahoman reported.

Separately, the commission agreed not to require the tribe to post a $1 million bond for the track. The tribe had objected and offered a $100,000 escrow fund for big prizes instead.

Also, the commission granted a conditional license for the Cherokee Nation's Will Rogers Downs racetrack after the tribe agreed to waive sovereign immunity.
