The Coeur d'Alene Tribe
of Idaho said it will seek an emergency appeal after a federal judge ordered a stop to poker games.
The tribe started offering Texas hold 'em games at the Coeur d'Alene Casino Resort in May. Judge B. Lynn Winmill said the games violate state law and aren't allowed under the Class III gaming compact.
As part of the compact, "the parties here expressly agreed that the tribe would not conduct other forms of Class III games," Winmill wrote in the decision. "As a result, the tribe has violated the Class III compact by conducting the Texas Hold ’em poker tournaments"
The tribe plans to ask Winmill to stay his decision in order to take the case to the 9th Circuit Court of Appeals.
