MOWA Band of Choctaw Indians wants gaming suit in federal court

The MOWA Band of Choctaw Indians in Alabama is seeking to have a gaming case heard in federal court.

The tribe operated a gaming facility that was shut down by the state. Authorities seized about 30 electronic gaming machines and filed a forfeiture lawsuit in state court.

But the tribe contends the case belongs in federal court, citing sovereign immunity, WKRG reported. The state wants the suit to stay in the Alabama system.

The tribe lacks federal recognition.
