Gaming opponents are still trying to shut down the off-reservation casino operated by the
Seneca Nation of New York.
The tribe opened a permanent home for the Seneca Buffalo Creek
Casino in August.
The facility is located on land that was placed in restricted fee status under the terms of the Seneca
Nation Settlement Act of 1990.
Judge William Skretny upheld the legality of the casino in a decision this May.
A group called Citizens Against Casino Gambling in Erie County is now asking the 2nd Circuit Court of Appeals to overturn the decision.
