A federal judge is due to hear arguments in a lawsuit aimed at stopping the Kialegee Tribal Town in Oklahoma from building a casino.
Last week, Judge Gregory Frizzell ruled that Indian Gaming Regulatory Act waived the tribe's sovereign immunity in connection with Class III activities. The tribe has entered into a Class III gaming compact with the state. Frizzell will be holding a hearing to consider the state of Oklahoma's motion for a preliminary injunction against the tribe.
