Vote set on embattled judge

Barring any last-minute freakouts, the Senate Judiciary Committee is voting today on the nomination of Charles Pickering to the federal bench.

Pickering is a federal judge in Mississippi. President Bush nominated him to sit on the 5th Circuit Court of Appeals, on which he would hear cases affecting tribes in Texas, Mississippi and Louisiana.

All Democrats on the panel are expected to vote against Pickering to create a 10-9 party line split. Bush yesterday criticized the way the nomination has been handled, calling it "unacceptable."

Pickering was forced to appear a second time before the committee. A vote last week was delayed by Republican request.

Pickering is considered "well qualified" by the American Bar Association. Democrats cite poor judgment on his cases while others criticize his civil rights record.
