A bill that would retroactively subject tribes to a gas tax is unconstitutional Idaho Attorney General Alan Lance has ruled in an opinion.

Lance's view didn't stop state lawmakers from pushing bill through the Legislature, though. The Senate State Affairs Committee on Thursday voted 5-2 to approve the measure.

The House has already approved the bill. The full Senate is set to vote on it today.
