Judge issues ruling on Oneida claim

The federal judge overseeing the Oneida land claim issued a ruling last week dismissing many of the state of New York's objections to the suit.

U.S. District Judge Lawrence E. Kahn rejected statute of limitations arguments advanced by the state. He ruled that the tribes are not time-barred in bringing the claim to 250,000 acres of land.

The suit involves the Oneida Nation of New York, the Oneida Nation of Wisconsin and the Oneida First Nation of Ontario, Canada. The Brothertown Indian Nation of New York, a non-federally recognized tribe, has been allowed to intervene.

New York Gov. George Pataki has outlined a settlement to the claim but its terms were only negotiated with Ray Halbritter, a representative of the New York Oneida. All other Oneida parties have rejected the offer and the Wisconsin have filed additional claims.
