A dispute over the status of a parcel of land in New Mexico is being fought in state courts.

In November 2001, a state judge dismissed criminal charges against a defendant because the incident in question occurred on land within the boundaries of Taos Pueblo although owned by a non-Indian. The defendant was a tribal member so the case would have to be prosecuted in tribal or federal court.

The local county is appealing the decision.
