Crow elk case before Mont. court

WEDNESDAY, JANUARY 9, 2002

The Montana Supreme Court on Tuesday heard arguments in a case over a herd of elk donated to the Crow Tribe.

A Montana couple donated 68 elk to the tribe, which transported the herd to its reservation. But the state, while conceding its wildlife laws may not necessarily apply to the reservation, said the move itself was illegal under state law.

An attorney for the couple said once the animals were put on a truck, the tribe owned them. As a sovereign government, the state's rules do not apply, the attorney said.
