A new report on the Wen Ho Lee spy case says the Los Alamos scientist was not targeted because of his Asian ancestry.

Lee, who was born in Taiwan, was jailed for nine months in New Mexico last year on espionage charges. His lawyers and some Department of Energy officials believe he was targeted because of his race.

The report, authored by a federal prosecutor who investigated the conduct of the FBI and the DOE, is to become public next week.

Lee and his wife has filed a civil rights lawsuit against the federal government. All charges but one, to which he pleaded guilty, were eventually dismissed.

Lee is writing a book about his experiences. Federal censors are considering whether the autobiography might violate security rules.
