The Senate Health, Education and Labor Committee voted 11 to 10 to approve the nomination of Eugene Scalia as Solicitor for the Department of Labor.

Independent Sen. James M. Jeffords of Vermont cast the tie-breaking vote, siding with Republicans who wanted to see Scalia approved. Democrats, led by Chairman Edward M. Kennedy (D-Mass.) were fighting the nomination due to concerns from labor unions.

Scalia's nomination goes to the Senate floor. He is the son of Supreme Court Justice Antonin Scalia.
