NEW: Santee Sioux Tribe wins casino fight

The Santee Sioux Tribe of Nebraska has won its fight to keep operating gaming machines at its tiny Ohiya Casino.

A federal judge today ruled that the "Lucky Tab 2" games in question are Class II machines. The tribe can operate them without a gaming compact with the state, the judge said.

The judge pointed to a classification opinion by the National Indian Gaming Commission and other rulings regarding Class II electronic aided machines.

The U.S. Attorneys office in Nebraska had been prosecuting the case. U.S. Attorney Mike Heavican has not said if he will appeal.
