Santee casino debate back in court

THURSDAY, NOVEMBER 1, 2001

The Santee Sioux Tribe and the federal government were back in court on Wednesday, arguing over the legality of new casino machines the Nebraska tribe says it should be allowed to operate.

The tribe says the "Lucky Tab 2" are Class II "technologic" games. As such, the games can be operated without a gaming compact with the state, the tribe argues.

U.S. Attorney Paul Boeshart feels otherwise. He said the machines are clearly Class III and thus prohibited in Nebraska.

Nebraska does not allow Class III, or Vegas-style gaming such as slot machines and blackjack. Amendments to the state's constitution to allow gaming in Indian Country have failed.
