Taxation of Indian businesses sought

The New York State Association of Counties on Thursday said they plan to ask the Legislature as well as Congress for bills imposing taxes on Indian businesses.

Although the state has the power to collect taxes on non-Indians, they have declined to do so and the state's Supreme Court upheld that right. Still, the group plans on targetting sales of cigarettes, gasolines, and other products to non-Indians.

In other states, tribes have compacts to address taxation of non-Indians. The state of Connecticut recently came to an agreement with its two tribes, but the products inolved there were created on-reservation, as opposed to off-reservation, a factor often significant in determining state taxation rights.
