Gaming compact dismissal refused

DECEMBER 22, 2000 US District Court Judge Neal McCurn on Thursday refused to dismiss a lawsuit brought against New York Governor Pataki challenging the state's compact with the Oneida Nation. The Oneida Nation wanted McCurn to move the case from the New York Supreme Court to federal court. But McCurn said the state's court is the proper forum. Former Governor Mario Cuomo signed the compact in 1993. The Oneida lawsuit was filed by the Upstate Citizens for Equality, which opposes the tribe's land claim. A similar lawsuit is pending against Pataki for the St. Regis Mohawk Tribe's compact. Get the Story:
