Judge prohibits tribal authority over school

A federal judge on Friday issued a permanent order barring the tribal court on the Fort Peck Reservation in Montana from exerting authority over a school.

The court has no authority over the actions of non-Indians on non-Indian owned land, said U.S. District Judge Richard Cebull. He also said there was no reason a tribal court should even consider whether it has such authority, citing Supreme Court case law.

The dispute arose after Wolf Point High School, which is located on the reservation, disqualified a basketball player after he received a failing grade. The mother of the student sought her son's right to play, which the tribal court tried to enforce.
