Miccosukee tribe tries to protect sovereignty

SEPTEMBER 26, 2000

The Miccosukee Tribe of Florida is trying to protect its sovereign right to exclude people from their reservation.

In this instance, the tribe doesn't want state investigators to come onto tribal land in order to subpoena witnesses for a first-degree murder case against a tribal member. Although the crime occurred off the reservation and the state has jurisdiction, most of the witnesses reside on the reservation and the state has attempted to subpoena several residents, to the protest of the tribe.

The tribe says it doesn't have to respond to the subpoenas and want both state and federal investigators off their land.
