Oneida land claim headed to court again

The Oneida Nation's and the New York counties of Madison and Oneida are heading back to court. US District Judge Neal P McCurn officially called off talks between all the parties involved and said none of the sides were willing to give up their own self-interests in order to come to a solution that would be beneficial for all.

A 1985 Supreme Court ruling gave the Oneida Nation the right to seek a settlement from the counties for 250,000 acres of land illegaly transferred out of the Oneida's control without federal approval.

McCurn still has to rule on a motion by the US Department of Justice, who have asked that 20,000 landowners and the state of New York itself be added to the suit. Both the government and the Oneida say they don't plan on evicting landowners or holding them responsible for rent.
