Winnebago Tribe wants Omaha suit dismissed

The Winnebago Tribe on Tuesday asked a federal judge to dimiss a lawsuit brought by its Nebraska neighbor, the Omaha Tribe, over an 1865 treaty.

But a lawyer for the Omaha Tribe says there is no reason to dismiss the suit. The tribe wants a court to enforce the treaty.

In the treaty, the Omaha Tribe sold part of its reservation to the United States government so that the Winnebago Tribe could settle on it. A treaty clause states the land can be bought back from the US should the two tribes fail to get along.

Members of the Omaha Tribe have long complained they have been ignored for the interests of the Winnebago Tribe. The Tribe is also upset the Indian Health Service decided to build a hospital on Winnebago rather than Omaha land.

The Winnebago Tribe signed a separate treaty with the government.
