Tribal sovereign immunity upheld
The Oklahoma Supreme Court has upheld the sovereign immunity of the Kiowa tribe. In their ruling on Tuesday, the court overruled a 1995 district court award, in which the Aircraft Equipment Co. had won a judgement against the tribe. Citing US Supreme Court sovereign immunity case law, the Oklahoma court ruled tribal funds could not be garnished to pay the award.
