Supremes to review disability cases

The Supreme Court on Monday decided to hear two cases affecting discrimination by private employers.

One case addresses the exact nature of "disability" under the act. An employee of Toyota says carpal tunnel syndrome prevents her from doing a critical part of her job and was fired for refusing a position which included some manual labor.

Toyota says ADA shouldn't apply because only some of her duties are affected. The company lost in an appeals court.

The second involves a disabled worker who was fired because US Airways has a policy favoring workers by senority. The 9th Circuit Court of Appeals disagreed and said disabled workers in need of accomodation should get priority.

The Supreme Court in February held that states have sovereign immunity from lawsuits under ADA.
