Decision limits Mi'kmaq hunting

Ruling that treaty rights can be limited in the name of public safety, Canada's Court of Appeal on Wednesday reinstated the conviction of a Mi'kmaq hunter.

Allison Bernard Jr. was convicted for hunting at night. In a practice known as "deer jacking," which is illegal under Nova Scotia law, he is alleged to have used lights to hunt for deer.

The Nova Scotia Supreme Court had overturned Bernard's conviction but three appeals court judges said the ruling was legally flawed.

An appeal is planned.
