Fisherman from the Burnt Church First Nation continue to set lobster traps in Miramichi Bay, in open defiance of attempts to regulate Native fisheries.

The Department of Fisheries and Oceans said they will seize the traps. The Mi'kmaq are setting the traps because they have enacted their own regulations they feel should govern their treaty-protected rights.

Band members voted on Wednesday 308 to 28 to reject federal management The DFO has offered Burnt Church 40 traps but fishermen say they may drop as many as 1,500.

Last year's landmark Marshall decision from the Supreme Court upheld the right of Mi'kmaq and Maliseet to maintain a living from fishing.
