Suit filed over nuclear waste project

The state of Nevada on Monday filed suit against the Department of Energy, hoping to stop the government from deciding to locate a nuclear waste depository at Yucca Mountain.

Yucca Mountain is under consideration to store the nation's highly radioactive waste. But the state, lawmakers, residents and area tribes oppose it.

The state in particular is challenging new rules that limit the study that goes into the project recommendation. Under the rules, which went into effect on Friday, the DOE doesn't have to prove leakage of highly radioactive waste into the mountain could damage the environment.
