The Narragansett Tribe of Rhode Island plans to open a tax-free tobacco shop, The New London Day reports.

Some state officials, including Gov. Don Carcieri believe the shop will be illegal. Some also say the tribe will have to charge state taxes.

Rhode Island is not a Public Law 280 state but the tribe's settlement act confers criminal and civil jurisdiction to the state. In similar situations, the Supreme Court has said state jurisdiction doesn't extend to state regulation.
