The Supreme Court on Monday announced it will not review a Republican attempt to keep retiring Senator Robert Torricelli (D) on the ballot in New Jersey.

The Justices rejected without comment an appeal of a New Jersey court decision that allows former senator Frank R. Lautenberg to appear on the ballot. The GOP alleged the decision violated law prohibiting last minute changes.

The Republican party plans to ask the Federal Election Commission to prevent Torricelli from donating $5 million in funds he raised to the Democrats.
